Attorney requests change of judge in lawsuit against election of Alberto Carrasquilla in Banrep República

The Office of the Attorney General of the Nation asked the Council of State send to the Administrative Court of Cundinamarca, the lawsuit against the election of Alberto Carrasquilla, as members of the Board of Directors of Banco de la República.

According to the Attorney General’s Office, the figure of first and second instance must be met in that case to preserve the right to due process.

The lawsuit against Carrasquilla’s election asks suspend and annul the decree Through which, he was appointed as a full-time member of the Board of Directors of Banco de la República.

What the lawyer Joan Sebastián Moreno, who filed the appeal, argues is that this election would be violating the gender quota law.

There is a direct threat to the Colombian legal system, by disrespecting the quota rules set for women to access positions of the highest decision-making level, especially, when the Belén Do Para Convention, Articles 13, 40 and 43 of the Political Constitution of Colombia and Law 581 of 2000 are violated, “said the lawyer in his documents.

The decree demanded is the 1032 of September 1, 2021, by means of which the President of the Republic, Iván Duque, appointed Alberto Carrasquilla to be part of the Bank’s Board of Directors, after the departure of Carolina Soto.

The resolution that is intended to be suspended through the precautionary measure is 1032 of the first of September, “by which a full-time member of the Board of Directors of Banco de la República is appointed.”
