The complaint filed by Vice President Cristina Fernández de Kirchner in the case for assassination attempt He will insist next Tuesday before the Buenos Aires Federal Chamber with his claim to extend the investigative statement to the three detainees and charge them with the crime of illicit association.
This is a hearing set by Chamber I of the Court of Appeals after the refusal of the judge in the case, María Eugenia Capuchetti, to order the request, judicial sources reported.
“We request that Brenda Uliarte, Fernando Sabag Montiel and Gabriel Carrizo be investigated for the factual platform collected so far which, in addition to revealing them as co-perpetrators of the crime of homicide, shows that they operated as an illegal association”indicated the lawyers in the appeal brief whose foundations they will expand on Tuesday.
The magistrate, by not arranging to expand the investigative statements to impute the new facts and give the defendants the possibility of making a defense, “forbids the possibility that the elevation to trial covers the facts that it has to cover and is qualified as it has to be,” according to the lawyers added.
The representatives of the Vice President José Manuel Ubeira and Marcos Aldazábal will also insist that one of the defendants prosecuted as a secondary participant, Gabriel Carrizo, should be considered co-author of the assassination attempt like Sabag Motiel and Uliartebased on new evidence incorporated after processing.
The arguments will be heard by judges Pablo Bertuzzi, Leopoldo Bruglia and Mariano Llorens in a hearing called for next Tuesday the 13th in person in the federal courts of Retiro.

Who is Carrizo?
“Remember this date”, “This hdp (sic) is already dead”, “You don’t know what we did with this”, “Create fear”, “So that the government knows who they are messing with”, are some of the messages extracted of Carrizo’s cell phone and incorporated into the case after processing as a secondary participant.
Carrizo was the head of the group of alleged snowflake sellers that Sabag Montiel and Uliarte worked for.
On the morning of September 2, hours after Sabag Montiel’s failed assassination attempt, Carrizo sent two messages: “It is a blow that we gave to the Government” Y “this is going to get worse”.
These and other messages were not attributed to Carrizo in his investigative statement and therefore “make an extension of the accusation prevailing.”
Capuchetti did not order the requested measures and the complaint appealed to the Federal Chamber, which last month confirmed the magistrate in the case but ordered to go deeper into the so-called “Milman track”linked to PRO deputy Gerardo Milman.
By then, the magistrate had already delegated the investigation to the federal prosecutor of Carlos Rivolo.
Last week the complaint filed another brief to ask the judge to seize Milman’s cell phone and the prosecutor new measures regarding this line, including cross-linking of calls between all those investigated.
But before the Chamber, the lawyers will insist on the role of the three detainees for the attempted aggravated homicide, who in their opinion should go to trial also prosecuted for illicit association.

Regarding Carrizo, emphasis was placed on messages sent the night of the attackwhen at 11:17 p.m. on September 1 he wrote to a contact scheduled as Kevin Bargas 2:

11:17 p.m. – “He wanted to shoot him”
11:17 p.m. – “He’s going to jail”
11:18 p.m. – “The gun is mine friend”
11:18 p.m. – “I swear to God”
11:18 p.m. – “We are with the group”
11:18 p.m. – “All together”
“At the time of processing, as we saw, the messages attributed to Carrizo were much fewer” and for this reason his role was classified as secondary participant, but “the truth is that the new number of messages, added to those already accused, impose prosecute Carrizo not as an accomplice but as a co-author”
In another message, Miguel Angel Castro Riglos (one of the alleged sellers of snowflakes) sent to the same group, at around 2:30 in the morning of September 2, the statements “Listo giroso at the end made Argentine politics unstable” and “We literally achieved the impossible , we put instability in the country”.
Faced with these messages, Carrizo replied: “Honestly, if they drop Cristina; they go down to the Cámpora; And with this we give a terrible blow to the Government; She has already been warned”.
