The federal judge María Eugenia Capuchetti requested the Justice of the City of Buenos Aires to refrain from further intervening in the cases related to the incidents and last Thursday’s attack against the Congress of the Nationwhose investigation added a new detainee in the last hours.
At your request, Capuchetti, argued that a split investigation cannot be carried out and that all the facts are part of a “broad hypothesis”linked to the attempt to hinder the functioning of one of the powers of the State, informed judicial sources.
Until now, the events that occurred on the day that Deputies discussed the agreement with the International Monetary Fund (IMF) were investigated through different files: in the federal case -in which Capuchetti and the prosecutor Carlos Rívolo intervene- the crimes could be framed under the figures of “aggravated damages” and “public intimidation”, facts different from those investigated by the Buenos Aires Justice, which has two people detained and investigates attacks against the local police and damage to the heritage of the City of Buenos Aires.
The case being processed in the federal jurisdiction of Comodoro Py by Capuchetti investigates the incidents in the vicinity of parliament, which included the stone attack on the office of Vice President Cristina Fernández de Kirchner, causing serious damage.
According to the last video released on Monday by the vice president on social networks, the attack that she defined as “serious and planned” lasted almost 23 minutes during which the stones did not stop, without the intervention of the City Police.
In her message, Cristina Fernández detailed with images in real time, from the outside and from the inside, the chronology of the attack that -she indicated- began at 3:07 p.m. when it is noticed how a small group of people throw red paint bombs against the window of the first floor where the office of the vice president is, with the presumed purpose of marking the place where the stones would point.
The incessant throwing of stones on the windows of the office located on the first floor of Congress continued until “20 minutes after the attack began, the first police officers arrive,” says the text that accompanies the images.
In this case and based on the analysis of images from the security camera of the Federal Police that is located on the corner of Hipólito Yrigoyen and Entre Ríos, just in front of the private offices of the head of the Senate, There are already eight people identified as the alleged perpetrators of the attack against Congressalthough judicial sources advanced that they are trying to identify other aggressors.
One of the detainees was arrested last night in San Isidro, suspected of having participated in the disturbances in front of Congress last Thursday, identified as Jaru Alexander Guerrero Rodríguez, allegedly linked to the Teresa Rodríguez Movement (MTR).
The other arrested by the Buenos Aires justice is Oscar Santillán, who has already been sentenced to preventive detention, after a hearing held on Monday morning.
The operation that led to the new arrest was requested by exhortation to the Buenos Aires justice by the Buenos Aires criminal and misdemeanor judge, Norberto Circo, who instructs a case for “attacking the authority, injuries and damages against the Buenos Aires heritage” as a result of the aggressions suffered by police officers and the damage to property of CABA.
According to sources in the case, the detainee would have been filmed overturning a “container” of waste in the vicinity of Congress.
At the same time, the same magistrate last night ordered a raid on the headquarters of the Teresa Rodríguez movement in the town of Florencio Varela in search of the suspect identified as Guerrero Rodríguez, 29, who was not found there but in San Isidro.
In the home raided by the police of that party in the north of Buenos Aires, four other people were also arrested for violating the drug law, since 51 marijuana plants were seized in the place.
On Monday, Judge Circo ordered the preventive detention of the first prisoner, accused of “having been part of an illicit association that was the protagonist and coordinated the incidents perpetrated in the vicinity of the National Congress.”
Meanwhile, Judge Capuchetti asked the judge in charge of the Criminal, Misdemeanor and Misdemeanor Court 23, Norberto Circo, to refrain from further investigating the incidents that occurred in the vicinity of Congress and decline his jurisdiction in favor of the federal court. 5, with a seat in the Buenos Aires courts of Comodoro Py.
“It is observed from the revealed film material that the actions of the various people investigated could have involved organized conduct prior to the consummation of the facts, in order to provoke the state of alarm that sanctions article 211 of the Penal Code, with the clear purpose of affecting the aforementioned legislative function,” said judicial sources when explaining the proposal of the federal judge.
Beyond the judicial investigation and the discussion about its competence between the federal and Buenos Aires justices, the discussion about facts that had their most serious expression in the attack against Cristina Kirchner’s office added new crosses, this time, between the authorities of the Senate and the Buenos Aires government, which sought to determine responsibility for the security flaws last Thursday in front of Congress.
The Administrative Secretariat of the Senate denied that authorities of the Chamber have communicated with the Buenos Aires government to request that security fences not be placed that day during the debate on the agreement with the IMF.
“The Secretariat categorically denies that any of the authorities of this Chamber have communicated with officials of the government of the City of Buenos Aires to request that security fences not be placed last Thursday, March 10, while the Chamber of Deputies was in session to discuss the agreement with the IMF,” says a statement released this afternoon.
The text was in response to the statements of the Minister of Justice and Security of Buenos Aires, Marcelo D’Alessandro, who said that it was Cristina Fernández de Kirchner who requested that the fences be removed from the perimeter of Congress.
In the text issued by the secretariat led by María Luz Alonso in the Senate, it was added that “there was also no communication to request that there be no exterior fences during the activity that is scheduled for this week in the Senate.”
“The only communication that the president of the Senate, Cristina Fernández de Kirchner, had with the then deputy head of the Buenos Aires Government, Diego Santilli, was on August 26, 2020, on the occasion of the treatment in the Senate of a project to reform the Judicial Power “, states the statement.
At that time, and in a timely manner, -he adds- “the city was asked to remove the billboards that they were putting up at that time and that had not been requested either, since a massive call was not planned. This telephone communication had wide media coverage”.
“On other occasions, as occurred during the treatment of the Voluntary Interruption of Pregnancy Law, which called for a broad social mobilization, fences were used preventively around the perimeter of the building,” the statement recalls.
The Government of Buenos Aires announced that it will have a perimeter fence around Congress during the debate on the agreement with the IMF in the Senate – which could be on Thursday – to facilitate police action in the event that the incidents that occurred when the law It was discussed in the Chamber of Deputies.
The announcement was made by D’Alessandro, within the framework of the presentation of the 2021 crime map by the Buenos Aires Executive, together with the head of Government, Horacio Rodríguez Larreta, at the Urban Monitoring Center.
“What we are going to do is generate a fence that allows the Police to act much faster, protecting themselves and those who are going to complain in the square,” said D’Alessandro,
In relation to the investigation into the group that threw stones at the vice president’s office, he stated: “We are working with the attorney general, last night there were raids and not only was there damage to the vice president’s property, but they almost set fire to a policeman throwing Molotov cocktails”.
“We are analyzing the cameras, identifying the violent ones and we are going to make them available to Justice,” he said.
