Asunción yields to questioned businessmen

On Wednesday, Álvaro Grau, councilor of Asunción for the Patria Querida party (PPQ), denounced that the Municipality of Asunción, managed by Óscar “Nenecho” Rodríguez, made irregular payments to owners of the EMPO Ltda Consortium.

It is G. 22,000 million (US $ 3.2 million) that the commune delivered as part of the termination of the contract produced in 2020.

Rodríguez gave an interview to 1080 AM where he points out that the payment was made through a judicial agreement. According to the mayor, the arbitration award ruled that the payment should be G. 44,000 million, so the reduction by half was an achievement for the commune.
The context is as follows; Alberto Abujamra, majority shareholder of the EMPO Ltda. Consortium, denounced that he was defrauded by the directors of the company; Enrique Ortuoste and Arivaldo Domínguez, and initiates criminal proceedings. Such a situation is reported to the administration of Óscar “Nenecho” Rodríguez in April 2021 so that it does not make new payments until the litigation is resolved.

VERSION OF THE AFFECTED
Julio Godoy, Alberto Abujamra’s lawyer, stated that his client was a shareholder of the EMPO Ltda Consortium, a company that was in charge of the final disposal of solid waste in Asunción.

“My client has been stripped of 50% of the shares he owned within the Consortium. We had warned the commune to refrain from making any payments related to these people”, he pointed out.

The lawyer stated that they were very surprised that the commune had disbursed the sum, despite the recommendations of the affected party not to make any payment.

The contract between EMPO and the capital commune was rescinded in 2020. The firm had a contract until 2035, so the rescission had a cost of G. 14,000 million for the commune.

“As my client found out about this situation, he asked the Municipality not to pay the amount in an erroneous way, considering that he was one of the legitimate owners. The striking thing is that they paid G. 22,000 million (US$3.2 million), the difference is the interest”, he explained.

Due to this situation, Godoy, on behalf of Abujamra, resorted to the Public Ministry, who summoned the Municipality for 72 hours to send the documents. The deadline expired on Wednesday.
“They are only unofficial information about possible payments, but we do not know when, how and where. We want to know if it was paid or not and who took the money.

Enrique Ortuoste and Arivaldo Domínguez are the businessmen denounced for this situation.

DETAILS
Alberto Abujamra was the owner of 50% of the EMPO Ltda Consortium. His lawyer was Arivaldo Domínguez. In the year 2020, the latter informs his then-boss of an offer to buy all of Abujamra’s shares for US$1 million. The businessman trusts his lawyer and agrees to the sale. However, the company was a briefcase so the payment never materialized.

It is because of this set-up for the purpose of fraud that Abujamra and his lawyer denounce Ortuoste and Domínguez.
