After the company Digicel Panamá S,A requested its voluntary liquidation because they claim there is no free competition of supply and demand, this afternoon the National Authority of Public Services (ASEP) informs the general public that in the Republic of Panama guarantees equal treatment and respect for the legal certainty of all regulated electricity, drinking water and telecommunications companies.
The ASEP highlighted that by virtue of the decision adopted by the operator Digicel, to request its voluntary liquidation on April 6, 2022, the entity is empowered, by law, to supervise that the provision of the concessionaire’s service is executed in an uninterrupted manner. , while the judicial process that they have presented before those instances lasts.
Armando Fuentes Rodríguez, general administrator of ASEP, stressed that the legal instruments empower the regulator to issue guidelines, rules and action procedures so that the purpose of respecting the principles of equal treatment for the equitable distribution in the allocation of the resources of the radio spectrum, in addition to guaranteeing the continuity of the service.
He highlighted that through Law 36 of June 5, 2018, the economic concentration between two mobile telephone operators was allowed by the Authority for Consumer Protection and Defense of Competition and said authority (ACODECO), through Resolution DNLC-M AC -005 22, granted a favorable concept to the concentration between CWP and Claro, subject to conditions that must be met.
According to ASEP, Panama has been a model for the region in matters that add value, such as Number Portability, which guarantees and stimulates free competition by giving users the right to choose the company that offers the best quality of service. services and prices, this entity also facilitates private investment within the regulatory framework.
