Argentine justice reopens complaint filed by Cuban Mavys Álvarez against Maradona

SAN LUIS POTOSÍ, Mexico.- Chamber I of the Federal Court of Argentina ordered this Tuesday to unarchive the complaint made in 2021 by Mavys Alvarez, the Cuban woman who accused Diego Armando Maradona and his entourage of abuse and human trafficking.

According to a note from the Argentine media InfobaeThe complaint had been rejected by Judge Daniel Rafecas, arguing that the crimes had expired over time, but Álvarez and his plaintiff lawyers, Gastón Marano and Marcela Scotti, insisted on carrying out a process to determine whether the accused are guilty or innocent.

As a result, judges Daniel Petrone, Diego Barroetaveña and Carlos Mahiques unanimously ordered the case to be reopened, this time focusing on the officials who allowed Álvarez to enter Argentina at the age of 16.

“Under such conditions, taking into account the approach made in this regard by the complainant, it appears necessary to clear up the doubts surrounding the possible intervention of public officials, for which it is appropriate to deepen the investigation and exhaust the study of that point on the basis of the evidence measures whose production is considered pertinent,” was the ruling of the courtconsulted by Infobae.

In this new stage, Carlos Ferro Viera and Gabriel Buono, friends of Maradona and his companions at parties and trips, will be investigated.

The complaint also points to dictator Fidel Castro, since the leader of the communist regime was, according to the victim’s lawyers, “an instrumental and necessary person for the irregular transfer of the victim to Argentine territory.”

“In any case, the victim remained in Argentina thanks to Fidel Castro’s permission and was returned when he ordered it, so his control of the situation never ceased,” they said.

They also stated that the family itself victim was infiltrated by Cuban counterintelligence agents.

Álvarez, who lives in the United States, had traveled to Argentina in mid-November 2021 to report to the justice system of that country the alleged abuses to which she had been subjected by the footballer.

Despite the fact that it was a “consensual” relationship between both parties, the Cuban woman says she was subjected to physical and sexual violence by the player, who also allegedly introduced her to drugs when she was barely 16 years old.

The episodes of violence by Maradona against Mavys Álvarez, then a minor, were offered by her in her sworn statement in Buenos Aires in the framework of the case presented before the Federal Court No. 10 of that province.

In conversation with InfobaeIn addition, the Cuban woman said that the footballer raped her in Havana.

“Maradona covered my mouth so I wouldn’t scream, so I wouldn’t say anything, and he abused me. My mother came to see me that day at the house where we were in Havana and Diego didn’t want to open the door to the room. My mother knocked and he didn’t open it. He raped me. That’s what happened,” said Álvarez.

That, she said, was “the worst” moment she spent with him. “Diego never opened the door. He never opened it. My mother kept knocking, going down, coming back, going up and knocking and crying behind the door because she knew we were there. He never opened it until he had to leave because he didn’t open it.”

Despite the seriousness of the case, and despite having presented evidence such as letters, photos and other documents, the accused were acquitted due to the statute of limitations and in March 2022 the case was closed.

A year later, demanding justice, Álvarez and his lawyers requested a “trial for truth” in Comodoro Py, a function never before granted in Argentine courts.

This type of trial would be carried out with the same rigor as a normal trial, but the accused would not receive a penalty even if they are found guilty. The aim is to compensate the victim by clarifying the truth.
