The Permanent Commission of Congress He approved this Thursday, with 12 votes in favor and 10 against, the final report recommended by archiving the constitutional complaint against the president Dina Boluarteinvestigated as alleged responsible for omission in the crimes of qualified homicide, serious and minor injuries during the anti -government protests between December 2022 and February 2023.
The accusation had been presented by former nation prosecutor Juan Carlos Villena and also included former prime ministers Pedro Angulo and Alberto Otárola, as well as the former headlines of the Ministries of the Interior and Defense: César Cervantes, Jorge Chávez, Víctor Rojas and Vicente Romero.
The document, prepared by Congressman José Jerí, argues that there are not enough evidence to prove a direct or malicious responsibility of those involved in the deaths registered during the mobilizations.
According to the report, the documents and testimonies presented by the Prosecutor’s Office do not clearly demonstrate that the former officials have used the state apparatus with the intention of causing deaths or injuries.
In addition, the application of the figure of the guarantor duty is ruled out, arguing that this is based on general constitutional norms and cannot attribute criminal responsibility in this case.
The complaint was linked to the events that occurred in Apurímac, Arequipa, Ayacucho, Ucayali, Cusco, Puno and Lima, between December 7, 2022 and February 9, 2023, a period in which Boluarte assumed the presidency after the dismissal of Pedro Castillo.
According to the Public Ministry, during that time 44 people died, 47 resulted in serious and 69 injuries with minor injuries.
