Appointment of Carlos Pimentel violates the law creates Public Private Alliance

The role of director of Public-Private Partnerships is incompatible with any other role in the State, except with teaching, according to article 19 of Law 47-20, which creates said entity.

Section six of the aforementioned legislation states, referring to who can be a director: “Not to hold any position or job of any nature with the exception of teaching activity.”

Yesterday, through decree 614-24, the Executive Branch appointed Carlos Pimentel, in addition to his position as head of Public Procurement (DGCP), as the new executive director of the General Directorate of Public-Private Partnerships.

Article 19 of Law 47-20 also states that to occupy this position, among other things, it is required: to be Dominican, to be over 25 years of age, to be a professional in economics, administration, finance, engineering or law and have experience for more than five years in any of the aforementioned areas, in the public sector or in the business sector.

The legislation in question, created in 2020, aims to establish a regulatory framework that regulates the initiation, selection, award, contracting, execution, monitoring and termination of public-private alliances.

The Directorate of Public-Private Partnerships had been headless since August 16, when its head, Sigmund Freund, assumed the Ministry of Public Administration.

The main contribution of the official in that position, in which he remained for four years, was related to the development of the province of Pedernales, where cruise ships have already arrived and several works linked to tourism are being carried out in that area.

Jean Luis Rodríguez was appointed as director of the Dominican Port Authority (Apordom) in 2020 and months later he assumed the general coordination of the Trust.

Jimmy Constantino García Saviñón, since the beginning of the first government of President Luis Abinader, was placed as president of the National Maritime Affairs Authority and recently appointed as general director of the National Aquarium.

With Decree 591-24, he was appointed as vice president of the Unified Council of Electricity Distribution Companies, in addition to his current position as executive president of the Council of Directors of the Patrimonial Fund of Reformed Companies (Fonper).

Retired general Juan Manuel Méndez has been at the head of the Emergency Operations Center (COE) for several years, but in 2022 as director of Medical Emergencies of the National Health Service.

These additional positions are not remunerated, under article 144 of the Constitution.

Intrant case

In November of last year, Colonel Randolfo Oniel Rijo Gómez, head of the 911 Security System, was appointed interim director of the National Institute of Transit and Land Transportation (Intrant). He assumed that position after Hugo Beras requested a license in the Intrant following the traffic light corruption scandal. On August 16, Milton Morrison assumed the Intrant after being appointed to those functions by the Executive Branch by decree 391-24.
