It should be noted that, before the process, the JEE itself had declared the registration of the Avanza País list inadmissible, however, this was rendered ineffective by a precautionary measure.
At yesterday’s hearing, the lawyer for People’s Renewal pointed out that the resolution of the Special Jury of West Lima 1 has no basis and affects the right to political participation.
“The election is valid, legitimate, and there has been no problem with it,” he assured.
He ruled out that there is a serious cause that has altered the result of the elections in that district. He indicated that in an ONPE technical report, prepared five days before the process, he stated that it was materially impossible to include the logo of Country advances.
“Here there is no impact on the election, there is no serious irregularity. What we have is the unenforceability of a precautionary measure that was given quite quickly and applied by the Special Electoral Jury in a quite irresponsible manner, ”he argued before the plenary session of the JNE.
He stated that since there was no irregularity, the annulment would not be possible.
In addition, he invoked the electoral preclusion, that is, the expiration of the terms in the process, which made the precautionary measure unenforceable for the party of Avanza País.
“There are 74% of voters in Lince who voted validly versus 26% absenteeism,” he remarked, asking the JNE to declare the decision of the JEE and the results are maintained.

For his part, the lawyer for the Purple Party stated that there are valid arguments to annul the elections in Lince and call a new process.
He argued that Renovación Popular is contradicting itself, because in the case of Lince it intends to ignore the arguments that it has raised in the request for annulment of the elections in Puente Piedra.
“We are facing a process of annulment of elections due to the serious irregularity that consists in not incorporating the logo of the political group Avanza País in the ballot papers for the district of Lince,” he said.
He stated that ONPE’s schedule was not affected because it was notified on September 20 of the incorporation of the Avanza País logo, that is, within the deadline for printing the cards, which according to the operational plan of the electoral entity the deadline It was September 23.
Neighbors and candidates for Lince, such as Elmer Arce Ortiz, of the Morado party, made a sit-in at the door of the JNE, supporting the nullity of the electoral process. There were also supporters of the winning candidate, Malca Schnaiderman, from Popular Renovation.
The president of the JNE, Jorge Salas Arenas, stated that the plenary session will decide according to law, without taking into account the shouts or threats, alluding to the demonstrations.
The Puente Piedra case will be resolved by the JNE
In the first instance, the Special Jury of Lima Norte 1 annulled the elections of the Puente Piedra district, by declaring the request of the Popular Renovation representative founded, who alleged irregularities against the electoral norm.
The JEE points out that the furniture of various voting tables had the inscription “Rennan Espinoza Foundation” stamped on it, the name of the winning candidate, from the Somos Perú party. He points out that this may have persuaded voters to vote for him.
