The complaint filed by the deputy Yanibel Ábrego, before the National Authority for Transparency and Access to Information (ANTAI), against the account of the Instagram platform “@traposxsucios”, was not accepted.
The complaint was filed on May 25, 2023, by Ábrego’s legal representative, lawyer Ceila Peñalba Ordoñez, for alleged dirty campaign and unauthorized use of personal image.
According to a statement from Antai, the facts denounced consist in the fact that the deputy has been seriously affected “by the use of assemblies, which not only affects the electoral contest with multiple widespread and ill-intentioned campaigns for offensive, dishonorable and slanderous purposes, but also that also violate their dignity and respect.
However, after the corresponding legal analysis, the Personal Data Protection Directorate determined that the reported facts are not the responsibility of this Control Authority, by virtue of the provisions of Law No. 81 of March 26, 2019 on matters protection of personal data, for which the complaint was not admitted.
