Former president Jeanine Añez has already gone to the Inter-American Commission on Human Rights (IACHR) and filed a lawsuit against the State for the lack of due process in the “coup II” case. This complaint will be supported by the latest revelations from former President Evo Morales.who admitted that prosecuting her through ordinary channels was a political decision of his and assumed within his party, the Government of Luis Arce and his social organizations.

The defense of the former president and her daughter, Carolina Rivera, informed EL DEBER that, in addition, from this step before this international body they demand that Añez defend herself in freedom and that all ordinary processes against her be redirected and that the Assembly Legislative, as “the true organ competent” so that a trial of responsibilities can be established.

“Petitions have already been presented to the IACHR, including for the lack of due processthe lack of a natural judge has been added since they forced (Jeanine Añez) to go through the ordinary route, which is not the competent judge to judge a former state president. Here we are going to include all this evidence and statements from all these former authorities who subjected my mother to these illegalities. “This is compelling evidence before the IACHR,” Rivera told this medium.

Lawyer Luis Guillén complemented that the new confessions of Morales and the former Minister of Justice Iván Lima, who admit that the right to be tried in a court case was violated, “are going to feed this process because they are confessions that are related to the violation of powers”, that is, that Áñez has not been judged by a natural judge. The complaint against the State before the IACHR was presented in May 2023.

Evo’s confession

On Sunday, October 6, Morales admitted that the former president’s fate was defined by the MAS. He acknowledged that the ordinary trial against Añez was a decision at his request and agreed upon in meetings with the Government of Luis Arce and leaders of social organizations related to the MAS.

“I had some meetings in Sacaba (with the Unity Pact), president (Luis Arce), vice president (David Choquehuanca), the minister of the Presidency (María Nela Prada) had been there, Iván (Lima) had been there, the Minister of Defense (Edmundo Novillo) had been there. We touched on that topic. We all said ‘it’s an ordinary process’. David (Choquehuanca) suspended because he did not have any argument to defend regarding the liability trial,” he confessed on his Radio Kawsachun Coca program.

According to Morales, the only one who opposed it was Lima, who was leaning towards a court case. The former Minister of Justice, a week earlier, also admitted that due to a “whim” of Morales, Bolivia may be subject to another lawsuit before the IACHR.

For lawyer Guillén, the confessions of Morales and former authorities are conclusive proof of how a political party subjugates the entire judicial system and instructs the direction of cases, violating the Political Constitution.

“This transcends further. It is not only the interference of the Executive, but it is the interference of a political party within our justice system. It is a political party that instructs how things are done beyond our Political Constitution of the State, beyond the current laws, and beyond the constitutional doctrine,” said Guillén.

Trials against Áñez

Since his arrest more than three years ago to date, Áñez faces nine proceedings against him, Among them are the “coup II” case for which she was sentenced in 2022 for “noncompliance with duties and resolutions contrary to the Constitution.” “Coup I” is another case that includes charges of terrorism, sedition and conspiracy for the violence that arose after Morales’ resignation in November 2019.

It also has another process for an IMF loan of more than $24 million; due to irregular appointments in the EBA company; the extension of the Fundempresa contract and a decree of alleged threat to freedom of expression in the coronavirus pandemic in 2020; economic damage to the State due to alleged irregularities in the subsidy for Jet-Fuel aircraft fuel, all when she was head of state.
