The first instruction hearing of the anesthetist Giovanni Quintella Bezerra will take place today (12), from 1 pm. The date was set by Judge Carlos Márcio da Costa Cortazio Correa, of the 2nd Criminal Court of São João de Meriti, of the Court of Justice of Rio de Janeiro (TJRJ).
In the process that runs in secrecy of Justice, the anesthetist was denounced for raping a woman during childbirth in the surgical center of the Hospital da Mulher Heloneida Studart, also in São João de Meriti, in Baixada Fluminense.
THE Nursing team, who was accompanying the surgery, became suspicious of Giovanni Quintela’s behavior and decided to record the crime using a cell phone, which was hidden inside the surgical center. In possession of the images, the nurses communicated the facts to the head of the hospital, who called the Civil Police.
Quintella was arrested red-handed on July 10 while still in the hospital. After going through a custody hearing, he had the arrest converted into preventive??
Defense
On November 1st, Judge Cortazio Correa denied the request for freedom to the doctor. According to the TJRJ, among the requests presented by the anesthetist’s defense, there was also the recognition of the illegality of the evidence obtained by environmental capture and, consequently, the absence of just cause due to the lack of evidence of materiality and criminal authorship. The judge rejected both arguments.
Indicted
Giovanni Quintella Bezerra was indicted on the 20th of July this year for the crime of rape of a vulnerable person. The inquiry sent to the Justice was completed by the Police Station for Assistance to Women (Deam) of São João de Meriti, where the crime took place.
Five days earlier, the anesthetist became defendant for the same crime, in a decision by Judge Luís Gustavo Vasques, also from the 2nd Criminal Court of São João de Meriti, who received a complaint from the Public Ministry of Rio de Janeiro (MPRJ) against the doctor.
Prosecutors pointed out in the complaint that “the crime was committed against a pregnant woman and in violation of the duty inherent to the profession”. The MP also asked that secrecy be decreed in the process, to preserve and protect the victim’s image.
For the magistrate, the Public Ministry’s complaint contained “the exposition of the criminal facts, with all their circumstances, the qualification of the accused, the classification of the crime and the list of witnesses”, he pointed out.
The prosecutors, who filed the complaint, understood that Giovanni Quintella Bezerra acted freely and consciously. “Willing to satisfy his lust, he performed libidinous acts other than carnal intercourse with the victim, a parturient woman unable to offer resistance due to the anesthetic sedation administered”, they indicated.
