This Thursday, November 27, the former president Pedro Castillo He was sentenced to 11 years and 5 months in prison for a coup d’état, the same sentence that his former ministers Betssy Chávez and Willy Huerta received, as co-authors of the crime of conspiracy to rebel.
The court also sentences Aníbal Torres to 6 years and 8 months in effective prison.
In that sense, criminal lawyer Andy Carrión considered the court’s decision optimal, considering that those involved were convicted of conspiracy to rebel, ruling out the alleged charge of rebellion.
“It was a very well-justified sentence, because in principle it was based on ruling out the crime of rebellion, but it did not mean that such serious acts of which all Peruvians witnessed, such as agreeing to attempt a coup d’état, went unpunished,” said Carrión.
“Strictly speaking, the crime of rebellion itself was not configured in the case of Pedro Castillo, because he had not managed to take up arms, and it was an important element to convict for this crime but there was an alternative sanction. The conspiracy for the crime of rebellion was an important element for which the Chamber made the decision to convict Pedro Castillo and the others involved,” the lawyer added.
On the other hand, he considered that because he was President of the Republic at the time of the coup d’état, Pedro Castillo should have received a greater sentence than his ministers, who committed the same crime but as co-authors.
“Pedro Castillo had a higher rank and I think he should have received a higher sentence, but the members of the Court have opted to put the participation of those involved at the same level. It is paradoxical how the Court has not graduated the imposition of sentences differently, we will see how this is assessed in a second instance, because it is evident that all the convicted people are going to appeal this decision.”
It should be noted that the court determined that former President Pedro Castillo committed the crime of rebellion and described this as a proven fact. In addition, it was proven with documents obtained from the former head of state’s home that he was going to comply with the specifications mentioned in his speech.
After the message he hugged Betssy Chávez and Aníbal Torres. Chávez told him “good president.” This moment was accredited by the room.
