The Spanish authorities arrested Anyeli Katherine Díaz Da Silva, alias La Barbie, in Madrid, who belongs to the criminal structure that operated in the Height 905 named band of the Koki.
The information is contained in sentence 404 drafted by magistrate Carmen Marisela Castro, where it is declared appropriate to request Spain to send Díaz Da Silva to Venezuela.
The extradition request is based on an arrest warrant issued against Díaz Da Silva issued on October 28, 2021 by the Fourth Control Court with Jurisdiction in Cases related to Crimes Associated with Terrorism. According to the investigation by the Public Ministry, Díaz Da Silva is involved in the crimes of aggravated kidnapping, obstruction of free trade, aggravated extortion, terrorism and association.
The arrest of Díaz Da Silva took place on November 3, as reported to Venezuela by the Interpol National Central Office in Madrid through verbal note No. EEG2/122408/DGE/72246/G2. The Spanish authorities proceeded to arrest the woman for presenting red notice No. A-9421/11-2022.
Upon learning of such arrest, prosecutor Miriam Lima Bernal activated the extradition process before the Fourth Anti-Terrorist Court, an office that in turn forwarded the file to the Criminal Chamber of the Supreme Court of Justice.
The aforementioned file contains approximately seven investigation reports prepared by the Cicpc which reflect the modus operandi of the Koki gang to commit kidnappings in Greater Caracas.
One of those records states that the criminal organization used women to attract potential kidnapping victims, whom they later transferred to Cota 905, keeping them in captivity until the ransom was paid in bolivars, gold, or foreign currency.
“Regarding the place of captivity, all the victims indicated that they are introduced inside a two-story house that serves as a kind of parking lot…in addition, the voices of adults and children are heard, roosters crowing…” the Investigation record transcribed in the sentence of the Criminal Chamber.
The magistrates verified that in this case all the requirements established in the extradition treaty signed between the Kingdom of Spain and Venezuela in 1989 were met.
The Chamber confirmed that Venezuelan legislation prohibits trial in absentia, which requires the presence of Díaz Da Silva in the country to proceed with his criminal prosecution.
By declaring the extradition request admissible, the Criminal Chamber established that it assumes the commitment that Díaz Da Silva will be prosecuted solely for his alleged participation in the crimes charged by the Public Ministry “with due assurances and constitutional guarantees.” ‘.
