AN 2020 advances in law to remove those who support sanctions from the political path

The AN-2020 representative Iris Varela participated in the debate on the Liberator Simón Bolívar Organic Law Project against the imperial blockade and for the defense of Venezuela, held this Thursday, November 21. In his opinion, the instrument had been longed for by the people who “have seen how the mechanisms of justice have been elusive to bring to justice and compensate for the damage that certain stateless people have done to the Republic.”


The National Assembly (AN) of 2020 approved in the first discussion the Pdraft of the Liberator Simón Bolívar organic law against the imperial blockade and for the defense of Venezuelaan initiative that arose in response to Law HR 825, also called the Bolívar Law, which was approved by the United States House of Representatives and which, for the government of Nicolás Maduro, attempts to subdue Venezuela with more sanctions and persecution.

«Every time they try to attack we will respond with a smile but with ferocity. We are not going to allow even one more to those rats of the empire,” said President Jorge Rodríguez, after the vote on the project, which was approved unanimously in the ordinary session this Thursday, November 21. The parliamentarian gave a period of one week to draft the norm and hold the second discussion.

The bill proposes to directly punish officials, leaders and citizens who support or incite, according to the State’s criteria, the application of sanctions “against the people.” The project, which obtained organic status, was presented to the plenary session by deputy Carlos Mogollón.

According to Mogollón, the bill was born from the “cry” of citizens who, he stated, have been victims of measures that constitute alleged crimes against humanity against all sectors of the population.

“This law arises as a tool to sanction people who, together with countries, manage, request or contribute in any way to the confiscation of assets and hinder the real Venezuelan economy in order to avoid impunity,” he commented.

He pointed out that the project consists of 18 articles and proposes disqualification for double the maximum penalty for those who ally themselves with foreign agents to affect people with sanctions. Then, deputy Jorge Rodríguez stressed that this disqualification must be perpetual.

Carlos Mogollón, who chairs the special commission that was created for the formulation of this law, highlighted that the project, once it becomes law and enters into force, will allow the facilitation of the application of the Domain Forfeiture Law “for the “that promote, defend the application of sanctions.”

The parliamentarian read to the plenary session part of what is established in article 2 of the law. According to his presentation, this says that “in the event that the defendant or accused refuses to attend the preliminary or trial hearings, it will be understood that he does not want to make use of his right to be heard, so he will be assigned a public defender (…) if they do not want to submit to the process then the people, invoking the protection rights of the victims, will judge them in their absence.

Beyond disqualification

Representative Iris Varela also participated in the P debatebill of law organic Liberator Simón Bolívar against the imperial blockade and for the defense of Venezuela. In his opinion, the instrument had been longed for by the people who “have seen how the mechanisms of justice have been elusive in bringing to justice and compensating for the damage that certain stateless people have done to the Republic.”

Varela proposed that the person who is found guilty of supporting the sanctions – an action that for Parliament constitutes treason – should have their identification documents and records of the companies owned by these citizens annulled.

He clarified that “although whoever betrays the country renounces his nationality, we are aware that the Constitution establishes that Venezuelans cannot be deprived of it.”

He explained that “no one” can say that the measure violates the Constitution. He argued that the Magna Carta in its article 44 says that the sentences cannot exceed more than 30 years in prison “in the case of custodial sentences.” He alleged that in this case these are political disqualifications, so the measure is not invalid.

Opposition in the AN raises its hand

The opposition bench raised its hand in favor of the bill. On behalf of the Democratic Alliance, deputy José Gregorio Correa expressed his support for the legislative initiative under the argument that the blockades and sanctions do not only affect a handful of officials.

«Sanctions for whom? For people who have nothing to do with public life,” commented the opposition parliamentarian from the speakers’ gallery. The deputy questioned whether the sanctions have advantages for citizens within the country. He described the instrument as “necessary and timely.” He stated that the rule must come into force to avoid impunity.

He insisted on the fact that the same leaders who have supported and celebrated the creation and voting of the norm by the US House of Representatives will want to participate in the regional elections that, according to the constitution, must be held next year. 2025.

“Those same people who wander around Altamira, Los Palos Grandes, are going to want next year to say that they want to be governors because they want to perform an ode to the past.”
