resolutions
The president has referred to the actions of ministers and former ministers in various matters. An example of this was in his conference on March 15, 2021 when he presented an analysis of the way in which José Ramón Cossio voted as Minister of the Court.
He voted against the project to declare various authorities of the IMSS, the government of Sonora and Hermosillo responsible for serious human rights violations for the case of the fire in the ABC Nursery, he declared himself prevented from participating in the action of unconstitutionality in the case of the Televisa Law; he refused to hold Eduardo Medina Mora and Enrique Peña Nieto responsible for the serious human rights violations that occurred in Texcoco and Salvador Atenco, he assured the president in his morning.
In May 2020, the president criticized ministers for temporarily stopping the so-called “maximum wage law.” with which it was stated that no public official received more than 111,990 pesos (6,000 dlls) the net monthly salary of the holder of the Federal Executive.
“Yesterday I did not like, I say it frankly, openly, with all due respect, the decision they made in the Supreme Court, to grant an autonomous body that its officials can earn more than the President of the Republic. I don’t know what was the interpretation that was used, what was the justification. As long as I am here and have the power to send bills, if it was not very clear how it is in article 127 of the Constitution, I could send another initiative to make it clear enough, ”he warned.
Months ago, in August 2019, the president sent an initiative to leave in the Constitution a legal cap on the salaries of officials, including those of autonomous bodies that had expressed resistance such as the National Electoral Institute (INE), the Bank of Mexico (Banxico), the Federal Economic Competition Commission (Cofece) and the National Human Rights Commission (CNDH).
The first chamber of the Court had granted a suspension to Cofece to prevent its workers from adhering to the Federal Law on Remuneration of Public Servants. Cofece commissioners had salaries of up to 200,000 pesos per month.
Another of the resolutions that annoyed the president was when Judge Samuel Ventura Ramoas ordered the release of those allegedly involved in the disappearance of the 43 normalistas from Ayotzinapa. The same judge who, according to the federal government, already had almost 120 releases for the issue.
“We have differences with the Judiciary, right now they are expressing themselves because of the attitude of the judge, who has released those allegedly involved in the disappearance of the young people from Ayotzinapa. A judge, one of those strange things, even though they are legal, of Tamaulipas and we are going to present, because we can do it, a complaint to the Judiciary of the Judiciary,” he said on September 15, 2022.
The president has also ensured that every time a judge makes an unsupported release of an alleged criminal, it will be exhibited.
“We do not accept that there is corruption in the Judiciary, we are respectful of the independence of the judiciary, but Every time a judge releases a suspect with legal elements in form, not in substance, that because the file is poorly integrated, with any other excuse, we are going to denounce it here “he commented on April 1, 2019.
Pretrial detention
The analysis to eliminate preventive detention by the Supreme Court took up several minutes of the morning press conference. The federal president described it as a shame that the judiciary protects alleged tax delinquents.
“It is very unfortunate, it is a shame, with all due respect. Imagine, the ministers protecting tax fraudsters and billing workers, even if they say what they say, it is protecting those at the top, the powerful, white-collar crime,” he launched. last november 25 .
“The Judicial Branch should not (should) take powers that do not correspond to it, it cannot annul an article of the Constitution, that is what the legislators are for. That is why the division exists, the balance between the powers, ”he said about the Court’s discussion around informal pretrial detention In November 2022, it was finally eliminated for the crimes of smuggling, fraud, and purchase and sale of invoices and was maintained for the rest of crimes such as intentional homicide, kidnapping, organized crime, among others.
The president also revealed that the ministers of the Court ordered the Tax Administration Service (SAT) to return 1,000 million pesos of taxes to Carmela Azcárraga Milmo, sister of Emilio Azcárraga, founder of the Televisa company, which he said, “it hurt him in the soul”.
“I believe that the powers should be reformed and that in the case of the Judiciary, with all due respect, they have not initiated a process of purification of reform, of cleansing that it requires, that it needs, that it is urgent to carry out in that power. They have just authorized that 1,000 million pesos be returned to him, my soul hurts in the depths, 1,000 million pesos to a taxpayer ”, he highlighted.
