The complaint was filed by the Ministry of the Environment and Sustainable Development (MADES), where it reported on a clandestine dump located in the Yvy Anguy neighborhood of San Bernardino.
Prosecutor Lisa Martínez, from the Specialized Unit for the Environment, which is in charge of investigation conducted a raid that allowed the collection of evidentiary elements that make the individualization of the person or persons responsible for the integral management of waste.
Along these lines, several procedures have been carried out, including the search of the property belonging to the Municipality of San Bernardino. The procedure was accompanied by a technician from the Specialized Directorate for Environmental Crimes and Supervisors of MADES.

In the place it was possible to observe the accumulation of household waste on the ground without waterproofing, without a floor and in the open.
The director of Asco Urbano, Derlis Agustín Barrios, was present at the site, and he stated that supposedly the site functions as waste transfer unit and that they were accumulated due to a mechanical problem in the truck compactor, a situation that made transport impossible for its final disposal in a landfill belonging to the firm El Farol SA, located in the city of Villa Hayes.
Subsequently, the legal adviser of the Municipality of San Bernardino, Diego Fernández, appeared, who denied what the director of Aseo Urbano had said and stated that the place raided does not function as a waste transfer plant, emphasizing that the accumulation of waste occurred due to mechanical failure in the only compactor truck that the municipal institution has.

The Facts investigated would be subsumed in Art. 200 Inc. 1st no. 1 and 2 and Inc. 2nd no. 3 of the Penal Code, with an expectation of imprisonment for up to 5 years or a fine, as well as in Art. 5° Inc. c) of Law 716/96 “That Sanctions crimes against the environment”, with an expectation custodial sentence of up to 5 years and a fine of 500 to 1,500 daily wages.
