HOW MUCH WILL I BE PAID FOR WORKING ON ALL SAINTS’ DAY HOLIDAY ON NOVEMBER 1?
If you have to work on Tuesday, November 1, which is a national holiday for All Saints’ Day, the law establishes that, if a worker works without substitute rest, he will receive a triple payment for the following concepts:
- Remuneration for the holiday: amount included in the usual salary.
- A second remuneration for the work carried out: Additional payment per day worked.
- A third remuneration for working on a holiday: for having worked on a holiday, without subsequent substitute rest.
The National Superintendence of Labor Inspection raises the following example: If a person receives S/1,500 (S/50 per day) as monthly remuneration, if they work on November 1, they should receive S/150 for the holiday worked.
HOW MUCH WILL I BE PAID IF I HAVE SUBSEQUENT SUBSTITUTE REST?
If you worked on November 1, but instead of a payment you want to have a day off, you can choose to request a substitute rest for that day worked. That is, if you work on that date you can ask for a break another day without any additional payment. HOW LONG WILL THE LONG HOLIDAY LAST FOR ALL SAINTS’ DAY?
November 1 is a holiday for All Saints’ Day, which this year falls on a Tuesday and comes with a long holiday. The government has decreed Monday, October 31, not working for the public sector, which will join Saturday 29 and Sunday 30 of this month, which are usual days of rest. In this way, you can enjoy four days off in a row from October 29 to November 1.
The Supreme Decree 033-2022-PCM indicates that this Monday, October 31, people who rest must compensate for those hours. The rule adds that the owners of public sector entities will adopt the necessary measures to guarantee the provision of those services that are essential for society during non-working days.
