Alcohumbre: STF decisions must be respected, but without curtailment

The President of the National Congress, David Alcolumbre (Brazil-AP Union), argued that the determinations of the Federal Supreme Court (STF) are accepted, but does not want to “curtail” to Parliament regarding the allocation of funds from the Union Budget. “The recent controversy over parliamentary amendments to the budget illustrates the need for mutual respect and common dialogue. The decisions of the Federal Supreme Court must be respected, but it is also indispensable to ensure that this parliament is not curtailed in its primary function of legislating, to represent the interests of the Brazilian people, including bringing resources and investments to all regions of Brazil ”, said alcohubre in the opening speech of the legislative year.

According to the senator, the executive, the legislature and the judiciary are not adversaries. “These are pillars that support our nation. We call harmony to balance, for only then will we safeguard the constitutional rights and prerogatives of the National Congress. ”

Alcolumbre promises to “work in harmony with the executive and the judiciary”, but points out that “it is essential that each power respects its functions and limits.” According to the senator, “Congress has its autonomy and its prerogatives.”

The President of the National Congress defends a strong, auto and, above all, respected legislature. “A congress that oversees, proposes, what debate, that makes it happen. A strong legislature is indispensable to democratic stability. ”

Joint work

In marking position, David Alcolumbre did not fail to preach dialogue, union, pacification, negotiation, mediation, cordiality and mutual respect.

This was the tonic of the speech of the mayor Hugo Motta (Republicans-PB). “The joint work of the three powers, independent and harmonic with each other, is at the heart of the country’s political regime, is at the heart of democracy that we should all worship and defend,” said Motta.

For the mayor, “this independence and this harmony presuppose the stubborn disbursement in the fulfillment of constitutional attributions and respect for the competences of other powers, guided always by the public interest.”

In a less institutional than usual tone, STF President Luís Roberto Barroso said that the powers have “direct, open and frank conversation of people who want to help each other and, when eventually diverge, we will be able to be able to sit on a table and institutionally absorb divergence. ”

He stressed that “more than the formal presence of the president of the Supreme here, in fact is the commitment of the judiciary to be partners in everything that, in the light of the Constitution, is good for Brazil.”

The Federal Supreme Court declared in 2022 the unconstitutionality of the so -called secret budget – the practice of the legislature to allocate public resources of the Union without explaining the parliamentarian who presents the amendment and without identifying the destination. The rapporteur of an action that questions the Supreme Court of Amendments, Minister Flávio Dino, has already suspended the payment of amendments in more than a moment because of the lack of transparency.

Commissions

With the resumption of legislative work, after the choice of new chamber and Senate directors, the next step is definition of the presidents of the thematic committees of the two houses, which should follow the proportionality of the size of each counter.

In the Senate, some leaders have already indicated the command of the chosen committees. The Constitution and Justice Commission, the most important, should be with PSD, with Senator Otto Alencar, from Bahia. The party should also indicate Nelsinho Trad, from Mato Grosso do Sul, for Foreign Affairs.

The MDB should indicate Senator Renan Calheiros, from Alagoas, for the Commission on Economic Affairs, and Marcelo Castro, from Piauí, for social affairs.

The PL should also have two commissions. Public Security, with Flávio Bolsonaro, from Rio de Janeiro, and the infrastructure, with Marcos Rogério, from Rondônia.

In the House of Representatives, the division of commissions is still under discussion.

The other priority this beginning of the year will be the budget vote. The Joint Commission on the subject should analyze the government’s proposal by March 10, after Carnival.

According to the Minister of Institutional Relations, Alexandre Padilha, the government in budget adaptations to adapt to fiscal adjustment measures approved at the end of last year, such as the minimum wage readjustment rules.
