By majority, the Constitution Commission approved the opinion that repeals Law 27600, which suppressed the signature of the former president Alberto Fujimori of the text of the 1993 Constitution.
Fourteen legislators from different parties supported the proposal that must now be debated and eventually approved by the Plenary of the Parliament to become law. Four legislators voted against and nine abstained, among them the parliamentarian for Peru Libre, Waldemar Cerrón.
Law 27600 was promulgated on December 15, 2001, and provided for the suppression of Alberto Fujimori’s signature from the constitutional text after declaring his permanent moral incapacity and, consequently, the vacancy of the office of the President of the Republic.

The norm in question was promulgated by the then President of the Republic, Alejandro Toledo, and endorsed by Roberto Dañino as President of the Council of Ministers, and Fernando Olivera as Minister of Justice.
The initiative approved today in the Constitution Commission specifies that the restitution in the 1993 Constitution of Fujimori’s signature – who, it is recalled, died on September 11 at the age of 86 – is “essential to safeguard the historical memory of Peru “.
“We cannot allow a law to erase an objective and constitutionally supported fact. The 1993 Constitution, ratified by popular referendum, was promulgated during the government of President Fujimori, that is an undeniable historical fact that forms an integral part of our national identity and our legal framework,” says the proposal that was presented by the congressman for Popular ForceNilza Chacón.
