The decision of eight ministers of the Supreme Court of Justice of the Nation (SCJN) to review the constitutionality of the reform of the Judicial Branch of the Federation (PJF) has no basis and was adopted more for political than legal criteria, considered President Claudia Sheinbaum. Rather, I say that it is a watered-down coup, not a coup d’état, because, honestly, what basis does it have?
He criticized the intention of the ministers who endorsed this decision: “what did they intend? I think that, first of all, provoke us to give them arguments to say: ‘oh, look how authoritarian they are!’ “We are not going to fall into any provocation, none.”
In this context, he announced that his government will not promote actions against these ministers, because we are not an authoritarian government, but a democratic one
.
In response to the SCJN’s decision, he emphasized that we will not fall into any provocation
but there will be an election of judges, magistrates and ministers of the Supreme Court, because that is what the constitutional 39 says, it is the decision of the people of Mexico.
He warned that eight ministers are not going to stop the transformation of the PJF, because it was a decision of the people. He recalled the correlation of forces in Congress that arose from the elections that gave his movement a qualified majority and, by having it, the Magna Carta could be reformed in the terms in which it states that they must be carried out, for which it was endorsed transform the Judiciary.
During her morning conference, the president considered that the objective of the ministers who approved reviewing the legality of the reform is for her administration to react by promoting impeachment and accusing them of treason. “That is not going to happen, even though nowhere in the Constitution does it say that the Court can change it or declare unconstitutional what has already been enacted.
I guess they are provoking, let’s see what our reaction is. And it is not only the ministers, but a group that gathers around the head of the Court, who are looking for a way to stop the transformation, which is the decision of the people of Mexico and eight ministers cannot stop it.
.
–Would what the Supreme Court is seeking to create at this moment be a crisis?
–Well, you should ask the Supreme Court, right? Or to the ministers. From my perspective, it is the defense of privileges, which they do not want to give up, nor those of those they defend. But Mexico changed and will continue to transform; that is a reality.
Sheinbaum insisted that the decision they adopted has no basis and the ministers know that they are acting illegally, because they are lawyers, they have formally read the Constitution and have applied it sometimes. In reality, what they are doing is defending privileges, to begin with their own, the 400 thousand pesos they earn a month.
–Isn’t the reform in danger?
–The reform of the Judiciary is not in danger. The people decided and we have the obligation to serve the people, just like the legislators. With the people, everything, without the people, nothing. The people rule.
The President also criticized the continuity of the strike in the PJF and denounced that this directly affects security, because since the judges are not on duty except for flagrante delicto cases, it is not possible for the Attorney General’s Office to obtain arrest warrants. required in legal processes.
