The Attorney General’s Office (AGU) will hire lawyers in other countries to represent Brazil in the extradition processes of 64 people convicted by the Federal Supreme Court (STF) of terrorist acts on January 8, 2023 against democracy and in favor of a coup of State.
These people are considered fugitives. There are at least 122 people convicted in this condition, according to a survey by the STF – they are not necessarily abroad.
The hiring of lawyers in other countries follows the Supreme Court’s determination to extradite convicted people. Extradition requests are forwarded by the AGU to the Ministry of Justice and Public Security, which verifies whether the request follows admissibility criteria required by law or by treaty between Brazil and the country where the fugitive is.
AGU note details that “the Brazilian State can intervene as a procedural party in foreign legal proceedings related to extradition requests, normally acting as a procedural assistant to the plaintiff, to contribute to the clarification of factual and legal issues that arise during the process. ”
In addition to the current 64 cases, new extradition requests may be made, and the resulting actions must be opened by foreign lawyers to be hired.
