The Federal Supreme Court (STF) filed on Sunday (13) three votes To confirm the suspension of the rule that equal to 55 years the minimum age for retirement of men and women civil and federal police.
The Court is deciding to refer to the individual decision of Minister Flávio Dino, rapporteur of the case, to suspend the rule, provided for in Constitutional Amendment 103/2019approved during the government of Jair Bolsonaro.
In October last year, Dino established that the age for retirement of civil and federal police women should follow the criterion of 3 years of reduction in relation to the period of men, ie 52 years. The measure should be adopted until Congress creates a new rule.
The analysis of the issue is motivated by an action filed by the Association of Police Delegates of Brazil (Adepol do Brasil).
According to the entity, the Congress disregarded the constitutional gender differentiation between men and women to grant special retirement.
To date, the STF records three votes to maintain the decision. In addition to Flávio Dino, the ministers Gilmar Mendes and Alexandre de Moraes voted. The votes of eight ministers are missing.
The case is judged in the Virtual Plenary of the Courtmodality in which ministers insert the votes in the electronic system and there is no face -to -face deliberation. The vote runs until Thursday (24).
