The modifications to the Amparo Law that came into force yesterday will make it possible to expedite this resource for the defense of citizens, since the trials will no longer be able to extend up to 10 years, as was the case, since the judges will have a period of three months to issue the resolution, warned Morena senators who ruled on this reform and consider that the campaign against the reform is only to defend privileges of the elites.
The president of the Legislative Studies Commission, Moreno’s Enrique Inzunza, rejected the annulment of protection in tax credits and bank accounts frozen by the Financial Intelligence Unit.
What is suppressed, he declared, is the provisional suspension that was granted, without going to the bottom of the matter, based only on what was stated by the complainant, which allowed, for example, he said, to unfreeze the bank accounts of Genaro García Luna’s wife and many other cases of money laundering.
A retired judge, the Sinaloan legislator stressed that the protection is not denied, only that before the definitive suspension the complainant must demonstrate that the frozen resources are of legal origin. Both parties, who is demanding protection and authority, have the possibility of presenting evidence in an incidental hearing and after that the judge decides.
It is a modification, he explained, that “has to do with a current problem, which is the use of the financial system to cover up the obtaining of resources that come from illicit activities” and is also consistent with the evolution of protection over the years.
Regarding a faster delivery of justice, Inzunza highlighted that in addition to the deadlines for judges, magistrates and ministers, the reform will allow the entire processing of the amparo trial to be digitalized in about two years and only exceptionally in the traditional way.
“If the amparo trial is promoted against acts of authority, of the three levels of government, there is a deadline for the authorities to have their password and registration and they will necessarily have to submit their justified reports, which is the response to the complainant’s demand.”
The reform establishes a deadline for judges to issue a resolution within 90 days following the holding of the constitutional hearing. He recalled that in President Claudia Sheinbaum’s initiative the deadline was 60 days, but after public consultations held in the Senate it was considered that three months was reasonable and the change was made.
They oppose the reform only for electoral purposes
Inzunza added that in trials for tax credits, the deadline is the same, but in the event that the protection is denied, the person who filed it has the right to appeal and if it is not favorable, go to direct protection. This shows, he added, that the narrative of the opposition parties, which claim, “only for electoral purposes,” that the citizen is left helpless, has no basis.
Regarding the campaign against the provision of not granting the suspension when it comes to acts that contravene social interest and public order – which was in the 1936 law – it is about preventing this resource from allowing the operation of clubs, lenociny centers or when sanitary measures are prevented to avoid an epidemic.
In turn, Senator Manuel Huerta Ladrón de Guevara stressed that what right-wing groups and the business elite don’t like is that protection will no longer be used to avoid paying millions in taxes.
