On May 4, 2022, the Plenary Session of Congress approved the bill by 107 votes in favor, 8 against, and 2 abstentions. The document had been approved last April 12 by the Legislative Economy Commission with the aim of alleviating the economic crisis due to the COVID-19 pandemic, as well as the rise in prices of fuels and basic necessities due to the war between Russia and Ukraine.

HOW COULD THE SIXTH WITHDRAWAL OF AFP FUNDS BE MADE?
If the proposal of the Congressional Economy Commission becomes law, the Superintendence of Banking, Insurance and AFP (SBS) will have a term of up to 15 days to establish the technical procedure for the sixth withdrawal, which according to the proposal would have the same scheme as the previous withdrawals:
- First part: 1 UIT (S/4,600) 30 days after the request is computed.
- Second part: 1 UIT (S/4,600) 30 days after delivery of the first amount.
- Third part: 2 UIT (S/9,200) 30 days after the second delivery.
WHAT HAPPENS IF I MADE THE REQUEST, BUT I NO LONGER WANT TO WITHDRAW THE MONEY FROM THE AFP?
In the event that the affiliate decides to stop withdrawing his funds from his individual capitalization account, he may request it from the AFP up to 10 calendar days before the disbursement. of discount, legal or contractual compensation or of any affectation, be it by judicial or administrative order.
WHO WILL BE ABLE TO ACCESS THE SIXTH AFP RETREAT?
In accordance with the opinion of the Economy Commission, all members of the AFPs, who are not of retirement age, will be able to withdraw the funds. The proposal also excludes those who withdrew up to 95.5% of their Individual Capitalization Account (CIC) and affiliates covered by the Special Early Retirement Scheme (Reja).
WHAT PROCESS IS FOLLOWED FOR THE SIXTH WITHDRAWAL OF FUNDS FROM THE AFP TO BE APPROVED?
Once approved, the autograph of the approved law must be sent to the President of the Republic for promulgation within a period of 15 working days. If he has no observations, the President of the Republic promulgates the law, ordering its publication in the Official Gazette El Peruano.
In the event that the president submits any observations on the proposal approved by Congress, he has 15 days to present it to the Legislature. If the term of 15 days expires, the president does not promulgate the proposed law sent, it is promulgated by the presidency of Congress.
The sixth withdrawal of contributions to the AFPs would become a law from the day after its publication in the Official Gazette A Peruvian manexcept for a different provision of the same law that establishes a longer period of legal vacancy in whole or in part.
