Documents from Public Records confirm that Horacio Cartes and Andrónico Luksic usurp land with false title. Even in 2007, the Ministry of Public Works compensated the legitimate owners affected by the works on the South Access Route of the land that today is illegally occupied by the Pulp plant, owned by Cartes and Luksic.

According to a lawsuit against “Bebidas del Paraguay” belonging to Grupo Cartes and its Chilean partner Andrónico Luksic, they would be occupying a property with false title, valued at more than USD 10 million. 50.01% of the shares of this firm belong to the Chilean businessman.

Public Records indicates that the property is individualized as Register No. 1134 and farm No. 1169 in the district of Ñemby, registered on May 19, 1999, belonging to Gladys Teresa Sanabria and with the variant in the name of María Auxiliadora Yegros, with an area of 67 hectares. However, the company “Bebidas del Paraguay” presented a presumably false title for 17 hectares with padrón No. 8039 of the district of San Antonio, totally different from the document registered in the Directorate of Public Records and data from the National Cadastre Service.

Also in 2007, the MOPC recognized based on documentation that the property belongs to María Auxiliadora Yegros and Gladys Teresa Legal Sanabria. At that time, they were compensated for an area of ​​9,137 m2 of land that was used for the construction of the South Access route, which today is located right in front of the Pulp plant.

The ordeal of the owners of the property began in 2003, when the firm “Bebidas del Paraguay SA” occupied 17 hectares of land with a false title. According to the original title, the property effectively belongs to María Auxiliadora Yegros and Gladys Teresa Legal Sanabria de Rojas. Since then, the owners tried to reach an agreement with the invaders, but all was in vain, since the occupants exhibited a presumably false property purchase and sale title made in favor of Francisco Barriocanal Jiménez Gaona.

This adverse situation led the victims to file a lawsuit against “Bebidas del Paraguay” in 2015, but in 2018 the balance favored the then president Horacio Cartes and the judge from Lambaré, María Teresa Cardozo, did not resolve the case and declared incompetent. Another judicial setback suffered by the victims was in the Central commercial and labor appeal court, where they confirmed the decision of Judge María Teresa Cardozo, arguing the exception of incompetence and that the case should be settled in the Capital.

Horacio Cartes has already been sued for occupying 50,000 hectares of land in Chaco with a false title, where he set up his Chajha agribusiness company. The title would have been falsified by the notary public Nelida Chávez, wife of the late Luqueño chartist leader González Daher.

The Ñemby area where “Bebidas del Paraguay” is located is strategic since raw material is easily extracted from the area, such as water from the Patiño aquifer, used for the production of beverages such as Pulp. In the same area there are also Coca Cola, Pepsi and others.
