A matter of trust: Digna Calle voted against rejecting Aníbal Torres’ proposal

The second vice president of Congress, (Podemos Peru), was the only member of the Board of Directors who voted against flatly rejecting the question of confidence raised by the head of the Ministerial Cabinet, Aníbal Torres.

Through her Twitter account, the legislator announced the reasons for her decision, which is based on literal d) of article 86 of the regulations of the National Parliament.

Said legal body states that the Plenary of Congress, by means of a legislative resolution and prior opinion of the Constitution Commissioncan declare inadmissible a question of trust, which is not equivalent to or qualifies as denial, refusal or rejection.

“My proposal is based on the request for confidence being referred to the Constitution Commission, in order to declare its inadmissibility, this in safeguarding the institutionality of the Congress of the Republic”he stressed.

Calle explained that this process guarantees that said pronouncement cannot be considered as a denial of trust and emphasized that Torres Vásquez’s approach should have been submitted to the prior opinion of the Constitution Commission and then debated in plenary.

As recalled, the Government resorted to this figure for a bill of the Executive Branch that proposes to repeal Law 31399, which protects the Political Constitution for limit the referendum.

However, the president of Congress, José Williams (Avanza País), reported that by majority the Board of Directors of that state power rejected the question of confidence presented by the prime minister.

In a document read by Williams Zapata, it is stated that the government’s initiative “directly interferes” with the exclusive and exclusive powers of Congress, and directly collides with article 206 of the Constitution, referring to the fact that all constitutional reforms must be approved by Parliament.

“The Board of Directors has agreed by majority to reject the question of confidence raised by Aníbal Torres on behalf of the Council because it deals with prohibited matters for the approach of a question of confidence, as established by the Constitutional Court in the foundation 185 of the sentence handed down in file No. 006-2019-CC and Law 31355″he expressed.

“Likewise, we have urged the Council of Ministers to scrupulously respect the constitutional and legal parameters for the presentation of the question of trust”sentenced the head of the National Parliament.
