A group of Cubans denounces harassment and an extortion attempt by Migration in Mexico

Authorities at the Zozaya immigration station in Guadalupe, located in the Mexican state of Nuevo León, are “illegally” detaining six Cubans who were granted an amparo on June 17 to carry out their process in freedom. Lawyer José Luis Pérez Jiménez denounces that the contempt is due to “an extortion attempt.”

The detainees Claridad Falcón Roque, Adrialys Caamaño Domínguez, Alejandro Lázaro Falcón Roque, César Mulet Marrero, Brian Michel Tasé Duarte and Dianet Ruiz Herrera, who are serving a month in the immigration station this Monday, “are incommunicado” and have been denied the possibility to establish contact with the Mexican Commission for Refugee Aid to adhere to the “refugee status for humanitarian reasons”.

The defender stated 14ymedio that the head of the representative office and the head of the legal department refuse to comply with the judge’s order under protection 713/2022. “They are asking for 63,000 pesos (more than 3,000 dollars), 10,500 pesos each, to set them free.”

The human rights of the detainees are being violated and article 111 of the Migration Law which indicates that “the detention and lodging may not exceed 15 days, especially since the restriction of their freedom is not justified,” said the litigant.

Pérez was also informed by the head of the representative office that the terms and conditions for the release of migrants “are established by them” and that they would let him know at the time of the departure of the Cubans.

“The Mexican government is doing the job for the United States,” said the lawyer. It is clear that “there are bilateral commitments to contain migrants and they have made us the Border Patrol and that is not our role.” These arrests encourage “the illicit enrichment of migration officials“.

The harassment of this group of Cubans was revealed through videos by the activist Linda Isabel Cancino Orantes. According to one of the detainees, Falcón Roque, since he has been in the migratory stay “he has not been able to continue with the treatment” for his allergy to gluten. For his part, Mulet Marrero is hypertensive, but in Zozaya “there is not even a device to measure pressure.”

Since 2019 there is evidence that migration officials do not respect the orders of district judges. “If we take into account the Castro-Chavista policy of President AMLO, there is an understanding between the Government of Mexico and Cuba and there have been recent clandestine deportations of Cubans despite the fact that they have suspensions granted by district judges,” Perez stated.

The Zozaya migratory station was evidenced in November of last year by a group of Cubans as a point of “extortion” and “xenophobia”in which migrants have paid from 1,500 to 3,000 dollars to be able to leave the place.

“The representative office of the National Migration Institute in Nuevo León and the one in the state of Zacatecas and the one in Tapachula, Chiapas, are the three most corrupt institutions in the country,” said Pérez.

Last April, the National Human Rights Commission verified that the poor conditions persist in Zozaya’s ranch. “Lack of medical care, overcrowding, dirty toilets, the distribution of raw food.” And he pointed to Immigration agents, “who threaten to establish punishments” for the detainees.

Through a releaserecommended “verifying each of the administrative immigration procedures of the people who are in that area so that their right to due process is respected and they do not exceed fifteen days of accommodation.”
