The mandatory review of the coercive measure imposed on the former Attorney General of the Republic Jean Alain Rodríguez is in a legal limbo, which makes the possibility of his being freed practically nil today.
Yesterday, Rodríguez was entitled to a compulsory review of the coercive measure, but the Fourth Investigating Court of the National District annulled it, because that court is no longer in charge of the case.
The Fourth Investigating Court of the National District served as the control court for the Medusa case and as such for the mandatory review of Rodríguez’s coercion measure, but it was dispossessed after the Public ministry made a formal presentation of accusation against the accused and the Third Court of Instruction was empowered.
Carlos Balcácer, who is part of the defense of Jean Alain Rodríguez, said that it is an abuse of power, denial of justice and violation of the mandate of the law.
He said that it was up to Rodríguez to be free, but since he was not aware of the mandatory review of the coercive measure, it has been impossible to debate the case in court. He maintained that his client was placed in preventive detention until the Public Ministry presented an accusation.
He recalled that the Public Ministry had until June 9 to present an accusation and did not do so, so he had to be summoned to do so within a new term that expired on July 7.

He argued that when the deadline expired on June 9 for the presentation of the accusation, Rodríguez has been imprisoned since then illegally and placed in a kind of legal limbo, because there is no one at this time who can review the measure of coercion. .
The accusatory file was deposited in the Third Court of Instruction, which is presided over by Judge Amaury Martínez. So far no date has been set for the preliminary hearing.
In that same order, the deputy attorney and head of the Specialized Attorney for the Persecution of Administrative Corruption (Pepca), Wilson Camacho, stated that it is now up to the authorized court to hear the accusation against Jean Alain and other defendants.
