Equal marriage: Senate gives support to the report of the Mixta

One step away from becoming law is the project on equal marriage. This, after the Senate endorsed by 21 votes in favor, 8 against and 3 abstentions, the report of the Mixed Commission, which must now be ratified by the Chamber of Deputies and Deputies.

The message modifies the Civil Code and other legal bodies to allow the marriage of same-sex couples and regulate the rights and obligations that those who celebrate it will acquire, making Chile the 25th country in the world to recognize equal marriage and the number 6 from Latin America.

It should be remembered that the report of the Mixed Commission cleared up doubts about affiliation, labor rights and updating of the gender identity law. In this regard, the senator Pedro Araya, president of the instance detailed the antecedents and processing of the legal text and valued the agreements reached, among others:

“The filiation of the child that is born by the application of assisted human reproduction techniques, will be determined with respect to the two people who have undergone them.”

“In no case may the establishment of the personal care regime be based on race or ethnicity, nationality, sexual orientation, gender identity or expression, personal appearance or any other category that is discriminatory.”

On labor rights: “The rights that correspond to the working mother referred to the protection of maternity regulated in this Title, will be applicable to the mother or pregnant person, regardless of their registered sex by gender identity. In turn, the rights granted to the father in this Title will also apply to the non-pregnant parent ”.

Likewise, two aspects of the gender identity law were updated.

During the debate, the senators thanked “those who have made this an important cause” and highlighted the progress towards equal rights; taking a step forward to give dignity; the end of arbitrariness and discrimination and the recognition of different types of family and love.

In another village, the votes against showed that the law does not affect love relationships, but rather the patrimonial; Furthermore, it was indicated that the project does not prioritize the best interests of boys and girls.

In addition, the Undersecretary of Human Rights thanked the vote, Lorena Recabarren and the Minister of Social Development and Family, Karla Rubilar.
