The fourth unitary court in criminal matters of Mexico City will resolve the appeals filed by the Attorney General’s Office (FGR) and the legal defense of Juan Collado Mocelo, against the resolution issued by Judge Felipe de Jesús Delgadillo Padierna last month past, and with which he refused to prosecute four lawyers related to the former Legal Counselor of the Presidency, Julio Scherer Ibarra, and who, according to the investigations, formed a criminal association.
Sources of the Judicial Power indicated that the disagreement was turned over to Judge Enrique Beltrán Santés, who in the next few days will decide whether to confirm, modify or revoke the decision of the control judge attached to the Federal Criminal Justice Center based in the South Prison.
Last May, during a hearing that lasted almost 24 hours, the Public Ministry wanted the control judge, Delgadillo Padierna, to issue an order linking him to the process against Juan Antonio Araujo Riva Palacio, César Omar González Hernández, David Gómez Arnau and Isaac Pérez Rodríguez, however, considered that the accusations were unfounded.
The foregoing, despite the fact that the prosecutors exposed an accumulation of 74 pieces of evidence with which they tried to prove that the four litigants and Scherer Ibarra formed a company to commit crimes from November 2018 to July 2021 and extort money from the lawyer Juan Collado Mocelo, and tried to force him to sell the company Caja Libertad to Grupo Afirme.
It even considered that the Public Ministry committed human rights violations, falsified evidence, made veiled threats and lacked evidence to prove the accusations and concluded that the FGR fictitiously accused, violating the right of presumption of innocence
accusations against both Scherer and the former head of the Financial Intelligence Unit (FIU), Santiago Nieto Castillo.
But not only that, on that occasion Judge Delgadillo Padierna asserted during his resolution that the accusations against Scherer Ibarra and the four lawyers could be revenge, since the complaint that gave rise to the imprisonment of Juan Collado was carried out with the accompaniment of the former legal adviser.
