The president of the Senate, Rodrigo Pacheco (PSD-MG), defended this Tuesday (21) a partnership between the Executive and Judiciary Powers in the search for solutions that meet the expectations of the Brazilian population. According to the senator, criticism from one branch to another must be observed, and the National Congress must stand by the side of the Brazilian people, of society, sharing solutions with both the Judiciary and the Executive.
“It is not the case that Congress takes a side, we have to have common sense and understand that there is a compatibility of Powers, each Power has its role, the Judiciary has its role to judge cases under its competence, the Executive Branch is the power that governs the country. So we have a lot of tranquility, a lot of serenity to deal with this and the possible criticisms of the life of one Power to another, or from society to some Power, we have to welcome the criticisms and see if they can make some kind of improvement”, he pointed out. after breakfast with the president of the Federal Supreme Court, Minister Luiz Fux.
Rodrigo Pacheco added, however, that “criticism cannot be allowed to be raised to the issue of aggression, offenses, cursing because that is of no interest to anyone”. Pacheco evaluated that, despite being independent, the Powers of the Republic “have a constitutional obligation to have harmony, so any gesture that aims at the disharmony of the Powers is a manifestly unconstitutional gesture”.
At the end of the meeting with Fux, in which 11 other senators, from the base and the opposition, also participated, Pacheco said that there is no forecast regarding the vote on the Proposed Amendment to the Constitution (PEC) No. 63. The PEC restores automatic promotion every five years (also known as quinquennium), with a 5% salary increase, to judges, prosecutors and ministers of higher courts.
For now, according to the president of the Senate, what there is is a manifestation of the importance that the restructuring of the career must be carried out together with the prohibition of super salaries through the vote on the extrateto project. A timetable for this process has not yet been defined.
The senator defended the consideration of the matter, which, he observed, will give the Brazilian judiciary “a fair logic, of having an indemnity character with an exhaustive and limiting role within the budget of the Judiciary to establish these indemnification funds”. For the senator, having a career restructuring that can lead to very exclusive dedication and very strict constitutional prohibitions can be a stimulus both to attract those who want to enter these careers and to make magistrates remain in it and be valued within this measure of reasonableness.
The five-year period was abolished in 2005 and the justification for its return, according to the president of the Senate, is the need to compensate for “deprivations” that members of the Judiciary and the Public Ministry (MP) undergo.
Asked if not advancing requests for impeachment against STF ministers contributes to this good relationship between the Powers, Pacheco said that he doesn’t care if he contributes or not and that, in this case, it is necessary to do the right thing. “Any action that has no basis, that does not have just cause, that does not have a fact determined by the law that disciplines the impeachment, naturally it must be denied by Parliament, if there is a concrete fact that justifies it, obviously the logic must be different, and it was not. A good relationship must be based on the attributions of each of the Powers and there is no need to think about these specific cases that are, of course, alien to the logic of harmony between the Legislative and Judiciary Powers”, he said.
In the interview, Pacheco also spoke about the increase in fuel prices. According to him, there is a strong will and a real front to contain this rise in prices, which has been harmful to inflation and to society. But the senator highlighted that it is necessary “to exercise due caution and make decisions that are correct, effective and have effective effects”.
Regarding the creation of a parliamentary commission of inquiry (CPI) on Petrobras, defended by President Jair Bolsonaro, the president of the Senate said that it is not up to him to give an opinion on initiatives within the Chamber. “But I particularly, the concept of CPI for a case like this, obviously I’m not favorable, I think there’s no reason to have a CPI at the time of this because of a fact like that. I think there are other measures, including those of a Legislative and Executive nature, that are much more useful to solve the problem than a CPI,” he said.
