MADRID, Spain.- The independent lawyer Sergio Osmín Fernández Palacios presented this Monday before the Working Group on Arbitrary Detentions (GTDA) of the Office of the United Nations High Commissioner for Human Rights (OHCHR) based in Geneva, Switzerland, a denounces in favor of Rafael Cutiño Bazán, imprisoned for the anti-government protests of July 11, 2021 in Cuba.
Through the profile Facebook of the Citizen Intelligence platform, of which he is director, the jurist explained that on 11J Cutiño Bazán joined the peaceful demonstration that took place in the Retablo de Héroes Park in the municipality of Bayamo, Granma.
“The young man, 27 years old, on his electric motorcycle headed towards the Avenida de los Mártires in the municipality, where hundreds of people joined, who shouted slogans such as `Díaz-Canel Singao´ and `Down with the Communists´. The peaceful passage of the protesters from Bayamo was abruptly cut off by a human barrier that was formed by very violent people dressed in civilian clothes, who arrived in a state truck from the Ministry of the Interior (…) and who unleashed a brutal repression against the protesters, including blows and strangulation, which is accredited in a home video taken on a mobile phone, ”explains Fernández Palacios.
Rafael Cutiño Bazán was arrested three days later, without being shown any arrest warrant or informed of his constitutional rights and guarantees.
He was subjected to a precautionary measure of Provisional Prison during the Preparatory Phase of the Oral Trial. He was not allowed visits from his relatives for about three months and he was subjected to police interrogations under duress without the presence of his legal representation.
“Deprived of liberty, he has been a victim of mistreatment. Due to the terrible conditions of the mattresses and bedding in the dungeons, it was infested like many with scabies,” the lawyer denounced.
Between May 24 and 26, 2022, the rigged trial oral before the Penal of the People’s Municipal Court of Bayamo. The Municipal Prosecutor’s Office requested sentences of up to 16 years in prison for Cutiño Bazán and the group of young people with whom he was tried.
Along with Bazán, Abel Quevedo Miranda, Ariel Axel López Ramírez, Bryan Eladio Vega Véliz, Carlos Rafael Ramírez Quiñones, Emmanuel López Martínez, Javier Rafael Paneque Oliva, Jenry Osmar Sánchez Aparicio, Jorge Iván Día Puig, Juan Alberto Matos Masó, Levys González were tried. Piedra, Luis Arnaldo Leyva Pérez, Maikol Fabián Figueredo Carbonell, Ricardo Fernández Osorio, Roberto Sosa Cabrera, Yoel Consuegra Ávila and Yoandris Gutiérrez Vargas.
