Jeanine Áñez, the second female president in the history of Bolivia, was sentenced this Friday to 10 years in prison for the case called Coup IIin which she was accused of the crimes of resolutions contrary to the Constitution and the laws and breach of duties, allegedly committed in her performance as a senator between the resignation of former President Evo Morales on November 10, 2019 until his arrival in power on November 12 of that year.

The First Sentencing Court, after deliberating for several hours, made the determination and communicated it to the parties, while he announced that the substance of the decision and the justification will be made known in the coming days.

Jeanine Áñez was arrested on March 13, 2021 in Trinidad, Beni, after an operation that was carried out, in person, by Police Commander Johnny Aguilera and Government Minister Eduardo del Castillo.

She was transferred from Trinidad to La Paz and the next day, on Sunday the 14th, a precautionary judge sent her to prison for the probable commission of the crimes of terrorism, sedition and conspiracy, For which the former MAS deputy Lidia Patty sued her. This process is called the Coup I case.

On March 18, the Plurinational Constitutional Court (TCP) eliminated the crime of sedition provided for in article 123 from the Penal Code and, therefore, no person can be prosecuted for this cause. However, the charges of terrorism remained in force, despite the recommendations of international organizations.

This fact complicated the construction of the ordinary trial. They did not prosecute her through a trial of responsibilities, which had to be approved by two thirds of the Assembly, precisely because the MAS does not have them, with the argument that she committed crimes as a senator, not as president.

The defense of Jeanine Áñez, specifically the jurist Alaín Canedo, pointed out that even the bloodthirsty Luis García Meza was tried with a court case, despite the fact that the murder of socialist leader Marcelo Quiroga Santa Cruz it occurred before the dictator assumed the de facto presidency. “Those are the inconsistencies in this whole story,” he commented.

It was in this way that the MAS, from the Executive and the Legislative, configured another strategy to judge Áñez like any common criminal.

On April 27, the president of the Senate, Andrónico Rodríguez, filed a lawsuit and said that, after six months of analysis and information gathering, seven other crimes allegedly committed by her were identifieddespite the fact that the former president was recognized during her year in office by leaders of other countries, as well as by international organizations.

In 2020, the Supreme Court of Justice invited her to the inauguration of the judicial year as constitutional president. The Plurinational Legislative Assembly, approved the call for elections in October of that same year and also the extension of mandate for subnational authorities. Áñez promulgated these norms also recognized by the Legislative Power as constitutional president.
