SANTO DOMINGO.- The Public Ministry assured this Monday that the accused of the Los Tres Brazos Case embezzled the State with the illegal sale of four million square meters of land, a fraud with which they had the expectation of earning some five billion pesos.

The statement was made by the prosecutor José Miguel Marmolejos, from the Specialized Prosecution Office for Administrative Corruption (Pepca), when approached by the press after Judge Juan Francisco Rodríguez Consoró, of the Sixth Investigating Court of the National District, postponed the reading of the ruling of the preliminary hearing for next Monday.

“Today the court notified us that it decided to extend or suspend the reading of the decision of the preliminary hearing for next Monday, motivated by the complexity of the process,” he said.

He explained that today the decision had not yet been delivered to the parties.

“The hearing was extended for next Monday, at 2:00 in the afternoon. The Public Ministry has requested in this process that an order be issued to open a trial against each of the accused, as well as that each and every one of the evidence provided by the Public Ministry be accepted, which is a quantity, both of documentary evidence as of witnesses, considerable”, he maintained.

He affirmed that they fully trust the accusation of the Public Ministry “and the convincing evidence that we have presented, which demonstrates guilt beyond all reasonable doubt as it will in the trial against each of these defendants.”

In response to the reasons why the hearing was postponed, he said that it was due to the complexity of the case. “Perhaps it means that, due to the large number of witnesses and evidence from all parties, the court may need a little more time to conclude the order. It is a situation that to a certain extent is foreseeable in such a complex case with so many elements to analyze, ”she specified.

In addition to Marmolejos, litigating prosecutors Isis de la Cruz, Ernis Mella, Rosa Pichardo, Wagner Cubilete and Aurelio Valdez represented the Public Ministry.

After concluding last November with the presentation of the accusation of the Los Tres Brazos Case, to which 17 people are linked, including Leoncio Almánzar, former director of the Dominican Corporation of State Companies (Corde), the Public Ministry requested that an order of opening to trial against the defendants.

In addition to Leoncio Almánzar, Manuel Aybar Ferrando, former real estate manager of that entity, is prosecuted for this case; Irving José Cruz Crespo, former legal consultant, and Rosabel Castillo Rolffot, former registrar of titles of the National District.

Likewise, among the accused are Juana Inés Gómez Williams, representative of the company Proyecciones Gowi SRL; Domingo Gerardo Lebrón de los Santos, president of Inversiones Fernández Parache y Asociados (Infepa), SRL, together with the employees of that company Carlos Aris Gómez Williams and Julio César Gómez Williams.

Also, José Enrique de Pool Dominici, main shareholder and representative of the real estate entity Titulatec; the surveyors Ana Antonia Ozuna Nolasco and Hadonis Ruiz Mella, as well as Lisetel González, who lent her name as a cohabitant of the accused Manuel Aybar, to receive two apartments intended to benefit Corde’s former real estate manager.

The Public Ministry also accuses the commercial companies Projections Real Estate Gowi SRL (Proyinsa), Electronic Solutions Sidenet SRL, Infepa, Titulatec SRL and Teknowlogic Dominicana SRL

On September 10, the criminal prosecution body resumed the reading of the accusation against those involved in the plot that alienated properties from the Dominican State and ordered the residents of the popular sector of Santo Domingo Este to buy the properties where they had been for decades. living.

The representatives of Pepca have highlighted during the judicial process that the then public official Leoncio Almánzar illegally sold, in exchange for a rural plot, one million square meters in which the sector is located. The Three Arms.

Prosecutors representing the Public Ministry accuse the group of embezzling and defrauding the Dominican state.

The accusation indicates that the aforementioned officials colluded with each other to violate the constitutional and legal system in order to embezzle the State, selling at pyrrhic prices an entire inhabited sector, to a group of businessmen grouped in the Infepa company.

The case has been legally classified as a violation of various articles of the Dominican Penal Code and Law 448-06, on Bribery in Commerce and Investment.
