This Wednesday, the Constitution and Regulation Commission, chaired by the Fujimori Patricia Juarezapproved the opinion of insistence of the law that reduces electoral fines and prescribes ongoing sanction processes by the National Office of Electoral Processes (ONPE).
Juárez Gallegos rejected the observations made by the Executive Power to the autograph of the law and presented the new opinion of insistence, which was supported by the majority of the commission without a debate in between.

The legal formula of the norm considerably reduces the fines imposed on candidates who do not inform the ONPE about expenses and income during the campaign. The current law establishes a penalty of “not less than 10 nor more than 30 tax units (UIT)”. However, the aim is to reduce this penalty to between 1 and 5 UIT.

It is also intended to establish a period of 1 year for the ONPE to determine if there was an infraction by the applicant. Otherwise, the sanctioning process will prescribe.
According to information from the entity led by Piero Corvetto, 12 congressmen maintain a process under way, of which eight voted in favor of this norm in the plenary session of Congress.
These parliamentarians would benefit due to the only transitory complementary provision of the law: “The provisions of this article are also applicable in sanctioning administrative procedures in which the sanction has not been fully executed.”
