The national public administration granted a special leave for 100 days to a fathera worker at the National Service for Agrifood Health and Quality (Senasa), so that he can play the main role of caring for his newborn baby, in a resolution described as “historic” and “unprecedented” by official sources.

Gastón and Nicolás got married in 2017, and two years earlier they registered in the Single Registry of Aspiring Guardians for Adoptive Purposes.
In five years they were never contacted, so in 2020 they began to evaluate other alternatives.
They then opted for surrogacy, which is not regulated in the country, so They made a presentation in the Family Courts so that the baby is registered as their son.
And they obtained the judicial authorization.
“Bearing in mind that surrogacy is not regulated and that the birth licenses that are legally contemplated are not suitable for new types of family, the team of our Legal Affairs Department worked on the regulations based on the collective agreement of work for the public administration that recognizes for the case of adoption, 100 days of leave without distinction in the gender of the adopters”, explained the head of Senasa.
And he stressed that “the right of children was prioritized as a fundamental element to argue the decision we made. In this way, an exemplary opinion was achieved, which generates jurisprudence and that puts in the foreground the rights of the child to be cared for by their parents Guillen added.
Pérsico thanked Guillén, Senasa’s vice-president, Rodolfo Acerbi, the entire technical team of the Directorate of Legal Affairs and other sectors “who intervened and took care to analyze and listen to my request.”
