After a controversial trial, ex-ministers of the Court are acquitted

Sindulfo Blanco and Víctor Núñez, former ministers of the Supreme Court of Justice (CSJ), were acquitted by the Sentencing Court. The judges concluded that the Public Ministry failed to demonstrate that the former members of the highest court had committed prevarication (arbitrary resolution, contrary to the law).

Yolanda Portillo, Héctor Cristaldo and Blanca Gorostiaga were the members of the Sentencing Court. While the representatives of the Public Ministry in this case were; Alma Zayas and Silvio Corbeta. The latter had requested three years in prison for Blanco and two for Núñez.

The mission of the prosecutors was to prove that the ruling in question was the only one issued by Sindulfo Blanco to verify that there was a contradiction in his actions. However, this was not achieved since it was not the same as Blanco issued in that sense.

THE CASE

On May 20, the Public Ministry requested a 3-year sentence for Blanco and 2 years for Víctor Núñez. Both were accused of giving rise to a cassation appeal (appeal that is raised to reverse rulings in which the laws are supposed to have been infringed) raised by the defense against a ruling by the Court of Appeals. This House had requested a new trial for Peter Kennedy in December 2014.

The then ministers belonged to the Criminal Chamber and issued Agreement and Judgment No. 1213 on December 2, 2014 in the “Peter David Kennedy on appropriation and others” case.

Both Blanco and Núñez declared admissible the appeal against Agreement and Judgment No. 16 of May 19, 2014, issued by the Court of Appeal of Villa Hayes, by which the final Judgment No. 278 of May 26 was annulled. December 2013.

In other words, according to the Prosecutor’s Office, with this determination, Blanco and Núñez breached articles 477 and 478 of the Code of Criminal Procedure.

For the collegiate, it was shown that the defendants did not commit any punishable act. Next week the sentence will be delivered and prosecutors Alma Zayas and Silvio Corbeta will decide whether or not to appeal the sentence.

We tried to contact the tax agents but they did not respond to our calls and messages at press time.

In an interview with the media, Núñez argued that, in his opinion, any type of final sentence can be subject to appeal. “There is no violation of the law but an interpretation of the law,” she commented.
