the congresswoman Norma Yarrow (Avanza País), with the support of other parliamentarians from its bench, filed a constitutional complaint against the Minister of Development and Social Inclusion, Dina Boluartein order to disqualify her from public office for 10 years.
The complaint sent to the president of the Subcommittee on Constitutional Accusations (SAC), Rosío Torres, indicates that the also vice president of the Republic would have committed an infraction of articles 2, 38 and 126 of the Political Constitution of Peru.
The document details that Boluarte would have violated article 2 by not having entered the name of his sister’s spouse in his affidavit of interestssince it bases that the norm stipulates that the relationship of relatives must be placed up to the fourth degree of consanguinity and second degree of affinity, that is, he should have declared the information of his direct family and the names of the spouses of his sisters.

Next, Yarrow Lumbreras maintains that the head of the Ministry of Development and Social Inclusion (Midis) violated article 38 of the Magna Carta by omitting the name of his brother-in-law in his affidavit of interests.
“This omission allows us to affirm that the Minister of State in the portfolio of Development and Social Inclusion and Vice President of the Republic, Mrs. Dina Ercilla Boluarte Zegarra, failed to comply with the express mandate of a norm, contravening the legal system”, he adds in the accusation.
Finally, the congresswoman from Avanza País asserts that An infringement of article 126 of the Constitution would have been committed, since -according to a report from the Comptroller’s Office- Boluarte Zegarra signed documents as president of the private association Club Departamental Apurímac while she was an official.
Said article establishes that the ministers “They cannot be managers of their own interests or those of third parties, nor carry out a lucrative activity nor intervene in the direction or management of companies or private associations.”.
