The Coalition for Human Rights and Democracy reported this Tuesday, May 8, that the First Military Court of Caracas sentenced retired General Ángel Vivas to seven years and six months in prison, for the crime of instigating rebellion. They reported that he was acquitted on charges of treason against the fatherland and military rebellion, remaining under the filing regime.

On March 25, the Coalition for Human Rights and Democracy denounced the attempts by prosecutors from the Public Ministry to have the case of retired General Ángel Vivas sentenced, despite the fact that the evidence presented could not be used in the evidentiary phase of the trial. trial, for which the lawyers Alonso Medina Roa and Ana Leonor Acosta pointed out that, according to a sentence of the Criminal Chamber of the year 2004, the police records do not constitute documentary evidence in a criminal proceeding.

On February 23, 2014, officials from the General Directorate of Military Counterintelligence (Dgcim) appeared at the home of the retired soldier, located in the Prados del Este urbanization, with an arrest warrant without the signature or seal of a court. General Vivas said that he would not turn himself in, barricaded himself in his house and declared himself a civilian in rebellion against the established authorities.

In April 2017, the soldier was finally arrested after going out to help a person who crashed his vehicle into the gate of his house, which was later denounced as a strategy to arrest him. He was missing for several days and was held at the headquarters of the Bolivarian National Intelligence Service (Sebin) known as El Helicoide.

Little more than a year later, on June 1, 2018, General Vivas was released from prison with precautionary measures by order of the Executive due to the serious health problems he developed in prison due to the cruel treatment to which he was subjected. He had a spinal fracture and prostatic hyperplasia that made it difficult for him to urinate.

In December 2021, the Inter-American Commission on Human Rights (IACHR) extended the precautionary measures in favor of the general’s family, as they consider that they are still “in a serious and urgent situation of risk of irreparable damage to their rights in Venezuela. ”.
