CBN says ruling against it is not final and announces appeal to TCP

Through a statement, Cervecería Boliviana Nacional (CBN) pointed out that ruling 52 of the Supreme Court of Justice (TSJ), with which it was sanctioned with a fine for alleged anti-competitive practices, is not final and that constitutional appeals will be presented grants the law.

The TSJ, through a ruling of October 2021, confirmed the sanctions of two fines against the CBN in favor of the State for an amount of 6.3 million dollars, according to a recent resolution of the highest judicial instance of the country .

In CBN’s opinion, the company’s fundamental right to due process is violated. In this context, he has denounced an alleged disinformation campaign on the part of the Cervecería Nacional de Potosí, which in the first instance reported on the court’s decision.

“The ruling violates CBN’s fundamental right to due process in its elements of justification, motivation, consistency and comprehensive assessment of the evidence. In this sense, like any other person or company, we have the right to defend ourselves against the unfair sanctions imposed, in all its instances,” the statement said.

CBN assures that the firm from Potosí “seeks to influence the final ruling in the highest constitutional instance and that it reserves the right to pursue actions against this company,” cites a bulletin.

“We trust that the pertinent authorities will not be influenced by the extortive publications of CNP, but will issue a resolution in accordance with the law, correcting the errors of Judgment No. 52,” he points out.

Likewise, CBN indicates that it respects the current legal and regulatory framework that governs healthy competition and demands that “legal matters be resolved before competent authorities and not in a sensationalist manner,” the statement added.
