Justice sentenced in Mercedes (Soriano) a teacher who sexually abused one of his students in 2018when the victim had 15 years. The man must fulfill two years and eight months in prison (with a discount for preventive measures completed), and pay the young person the money equivalent to 12 monthly income.
The Court of Appeals ruled for the second time, after the accused has been acquitted but the prosecution has appealed the sentence of first instance, the public ministry reported this Thursday. The man was now sentenced for a crime of sexual abuse especially aggravated.
Furthermore, the Justice his parental rights were suspendedand also was disqualified from working in the educational area, both in the public and private spheres, which involves direct dealings with children and adolescents, people with disabilities and elderly people who are dependent, for a period of 10 years.
In October 2018, the teenager was surprised by the teacher – who was in his vehicle – while he was walking down the street, in the direction of a friend’s home. The condemned man (whom the victim knew as his teacher) offered to take him to the young woman’s, to which the young man accepted. On the way, the teacher asked him how old he was (15) and told him that before taking him to where he was going, he had to go through his house.
Once there, he invited the victim to come in and told him to go to the second floor of the house, where he had items related to his work. The man blocked the exit door with a chair, and sexually abused his student.
When the teenager managed to leave the house and reach his friend’s, he told her what had happened. The prosecution reports the mother of another friend found out what happened, she accompanied him so that the young man could tell her sister, who made the police report.
In the judgment it is stated that “the minor gives a clear and consistent version of what he denounces”. There is psychological skills that provide the “expected reaction in this type of situation of sexual abuse and analyze the personality of the accused, for which concludes that the context of the events was contemplated”, indicates the text.
“I see no reason for such a false accusation and everything that happened after, except an orchestrated conspiracy to harm this suspect, which I rule out. There is violence with the fact of blocking the exit by locking the young man in the place, it is not necessary more than that so that his will has been clearly constrained ”, the ruling adds.
In the opinion of the Court of Appeals, the evidence (police actions, testimony of the victim and witnesses, expert evidence and other indications) unequivocally to conclude that the defendant actively participated in the wrongful act for which he is accused.
