The bill that seeks to defend drivers sanctioned with photofines on the roads of the country was approved this Tuesday in the first debate by the Sixth Committee of the House of Representatives and thus takes its first big step in its process in Congress.

According to the author of the initiative, Katherine Miranda, what is sought with this is a modification of the current regulations so that due process is guaranteed in the defense of people who are sanctioned with the photo fine model.
The Congresswoman explains that the project contemplates that when an alleged infraction is committed, the traffic authorities will have three days to validate the subpoena and after that, the sanctioned person must be notified within the three days following the validation of the subpoena. .
For that Article 8 of Law 1843 of 2017 and Article 135 of Law 769 of 2022 would have to be modifiedin which the regulations on the photo fine model are contained.

For the author of the initiative, as this system works today, the alleged offender is not allowed due process in the preliminary stage, since there is currently no term for transit entities to verify the alleged infraction detected by the system.
This would also lead to transit entities being obliged to identify the offender, who in some cases is not the same owner of the vehicle, so that the first and not the second is the subject of the infraction.
“We want those investigated to have guarantees in the process carried out by the entities, because currently the regulation that is in force does not satisfy the requirements in the preliminary stage. With this bill, it will allow due process to be really complied with in administrative actions,” concluded the Representative of Alianza Verde.
