The application of "Ancho" Ramírez is postponed again

The Council of the Judiciary declared in fourth quarter for the second time the impasse generated by the candidacy of Juan Bartolomé “Ancho” Ramírez. Again there was a tie in four votes for the rejection or authorization of the former senator’s candidacy.

The process will continue on Wednesday at 3:00 p.m. The beginning of the public hearings is suspended, until the impasse in the admission stage is resolved. Once this stage has been resolved in any way, the public hearings will only be rescheduled.
The public hearings should have started on Monday with four candidates, Hermelinda Alvarenga, national senator for the PLRA caucus “C” was one of them.

CONTEXT
Last Monday 18, the Council of the Judiciary carried out the documentary analysis of the then 34 candidates to be the next Ministers of the Superior Court of Electoral Justice (TSJE).

The analysis resulted in the elimination of five candidates, leaving 29. However, the day was declared in the fourth quarter after a four-vote tie when dealing with the disqualification of candidate Juan Bartolomé “Ancho” Ramírez. The now former senator is accused of belatedly submitting his attorney registration certificate.

The meaning of the votes were as follows; Óscar Paciello, Eugenio Jiménez, Mónica Seifart and Pedro Santacruz voted against. In favor they voted; Jorge Bogarín, José Raúl Torres Kirmser, César Ruffinelli Buongermini and Roberto González.

The first stage of the selection consists of the documentary analysis of the applicants. The second thing is the public hearings and finally, as a third point, the exams.

After two hours of debate, the councilors voted again in the same direction as the previous week, so the impasse could not be overcome.

BOGARIN
Jorge Bogarín, representative of the lawyers’ union, affirmed that, not having the votes, Ramírez’s candidacy should be admitted. Taking into account that the regulation refers to the votes for rejection, not to the votes for admission.

Roberto González, representative before the Chamber of Deputies, and César Ruffinelli Buongermini, representative before private universities, echoed Bogarín’s request. Ultimately, however, this proposal was unsuccessful.

MORE QUESTIONS
Juan Bartolomé “Ancho” Ramírez, a former national senator, resigned from Congress to run for the TSJE. The now ex-legislator was the target of questions because he does not comply with the provisions of article 275 of the National Constitution.

The article says verbatim that “during a term of 10 years, at least, (the applicants), they must have effectively practiced the profession.”

According to the documents provided by Ramírez, he was only sworn in as a lawyer in August 2012, taking his oath in November of that same year. As the elections will be held in April, the established period of time has not yet been met.

In the event that the impasse on the presentation of your registration is overcome, the members of the Council of the Judiciary must analyze what is related to article 275 of the National Constitution.
