HRW director hopes ICC office in Caracas collects evidence and investigates

Tamara Taraciuck believes it is essential that the ICC office in Venezuela can listen to the victims and give them a space in the investigations


The director of the NGO Human Rights Watch (HRW) acting for the Americas, Tamara Taraciuck, hopes that the new office of the International Criminal Court (ICC) that will be installed in Venezuela will really be used to collect evidence and investigate the alleged crimes of against humanity of which the Venezuelan State is accused and “does not cooperate in attempts to reform Venezuelan justice.”

Taraciuk believes that the visit of the ICC Attorney General, Karim Khan, to Venezuela was “controversial” because very little was known about the purpose of the meeting with the authorities of our country and highlighted the rejection by that body of the attempted attempt by the administration of Nicolás Maduro to stop the investigation, alleging that efforts were being made to provide justice with Venezuelan mechanisms.

For the director of HRW for the Americas, it is “key” that the ICC Prosecutor’s Office can listen to the victims of human rights violations and the NGOs that are interested in seeing justice done, detailing that in Khan’s last visit to the country he did not there was a meeting with these sectors but only with the Executive.

“It is important that from now on the situation of the victims, their relatives, and the NGOs that work together to collect evidence be taken into account,” he said in an interview with VPI.

He explained that they supposedly only met with the official sector because it is with them that the conditions to open the ICC office are negotiated, but he did emphasize that an effort should have been made to publicize their actions in the country.

He clarified that for the time being, we must wait for the ICC Pre-Trial Chamber to make a decision to continue the investigation in the Venezuela I case, for which he said that it is currently in custody.

Regarding the Caracas office of the ICC, he highlighted that there are two paths along which the process is going: one, concerning the investigation followed by the State and the other, the efforts of cooperation with the authorities to assist in the efforts to reform Justice.

In this sense, Tamara Taraciuck believes that the measures taken by the Venezuelan authorities “do not work” because there has been damage to justice since 2004 and few processes will not solve all the problems.

He explained that the “attempt” to have a TSJ of 20 magistrates will not work because the Nominations Committee is made up of deputies from a National Assembly elected in 2020, which, in his opinion, was a process questioned by the international community and that there are no guarantees. of the election of members who can act independently.

In his opinion, the ICC should promote the investigation and take advantage of the office in Caracas to have access to the case files, the detention centers and other instances to delve into its investigations, which will allow it to have evidence of the alleged crimes. crimes against humanity of which the Venezuelan State is accused.

Similarly, he recalled that individual responsibilities are investigated; which suggests that the responsibility of the material authors of any violation of human rights and also those who make up the chain of command can be established.
