Ombudsman: letter sent by Pedro Castillo violates standards in freedom of the press and expression

The affirmed that the notarial letter sent by the president to the program ‘Panorama’ in which he asks him to rectify himself for a journalistic note broadcast last Sunday, April 10, transgresses the standards in terms of freedom of the press and expression.

Through an official letter sent to the president, he stated that said letter violates article 2, paragraph 4, of the Constitution, which establishes freedom of information and expression as fundamental rights, by any means of communication, without prior authorization or censorship or any impediment. , as well as article 13 of the American Convention on Human Rights, referring to freedom of expression and of the press.

Likewise, it states that the communication violates the standard of “greater tolerance on speeches related to officials and public figures”since it omits that every state authority must have a wide openness regarding those expressions and/or information that are related to their public work or regarding the suitability to hold public office.

In the same way, it ensures that the letter violates the standard of “special protection of the media and journalists, based on the work they do in our democracy”given that he is unaware that this protection responds to the fact that thanks to the media and journalism in general, citizens can be duly informed.

It also indicates that said communication violates the standard of “minimum restriction on freedom of the press and prohibition of censorship”by which the State must avoid restricting by any means the free dissemination of ideas or information, especially when the freedoms of expression and information are exercised by journalists.

“For our institution, both freedom of expression and information can be violated when the criminal sphere is resorted to -as threatened in your document- as a means to intimidate journalists”he underlined.

Finally, the advocacy considered that this type of “Attacks on the media” not only does it violate the Constitution and the American Convention, but it is also not consistent with the discourse of national reconciliation that Castillo Terrones has been proposing, so in his institutional opinion, the notarial letter should be annulled.

As recalled, according to the notarial letter sent to Roxanne Cavedirector and host of ‘Panorama’, in the report it is intended to link the words of the lobbyist karelim lopez in the sense that he has maintained or maintains relations with people who would belong to an alleged mafia linked to Chinese mafias who would be unduly favored with contracts at the Ministry of Transport and Communications (MTC).

“In that sense, I categorically deny, once again, knowing Roberto Jesús Aguilar Quispe, who is not the person who participated (in) the aforementioned entertainment activity, as falsely stated in the news information disseminated by you”he detailed.

Thus, Castle Lumps requested that within 24 hours of receiving the notarial letter, they rectify their statements, otherwise they will take civil and criminal actions for the crime of aggravated defamation, provided for in article 132 of the Penal Code.
