The Superintendence of Industry and Commerce (SIC) issued external circular number 04 of 2022, which gives a series of guidelines that must be followed by those who organize and promote “public performances of the performing arts” (concerts, plays, staging).

The standards issued by the entity are aimed at both natural and legal persons and focus on how to react to claims filed by consumers when cancel or modify these types of events.
“These instructions seek to guarantee the effective protection of consumer rights, as well as to facilitate understanding and compliance with consumer protection provisions by entrepreneurs.”, explained the SIC
THE RULES
As announced by the SIC, there are five measures consisting of:
1. The claims of effectiveness of the guarantee that natural or legal persons receive for the cancellation or modification of public performances of the performing arts, which have as a direct cause the fulfillment of the measures adopted to contain the contagion of covid-19, will be processed according to the term stipulated in the Article 5 of Legislative Decree No. 818 of 2020.

two. Claims of effectiveness of the guarantee received by natural or legal persons for the cancellation or modification of public performances of the performing arts, for any reason other than that stated in the previous paragraph, will be processed in accordance with the general protection rules. to the consumer in force, in particular the Law 1480 of 2011 (Consumer Statute).
3. The SIC has the power to order any type of measure with the purpose of avoiding harm or harm to consumers in the event of suspension, cancellation or rescheduling of public events of the performing arts.

Four. In case of suspension, cancellation or rescheduling of public events of the performing arts, consumers who seek the protection of their particular interest may file effectiveness claims of the guarantee before the delegation of Jurisdictional Affairs of the SIC in the terms of the current regulations.
5. Natural or legal persons dedicated to the organization or promotion of public shows must provide timely, clear, truthful, sufficient, verifiable information, understandable, precise and suitable for consumers on the suspension, cancellation or rescheduling of public performances of the performing arts.

The measures taken by the SIC are made known after the failure of the Jamming Festival and in the midst of a 2022 that is marked by several shows in Colombia, among which the concerts of Dua Lipa, Coldplay, Daddy Yankee, Bad Bunny.
