The federal government published today (29) the Provisional Measure (MP) 1,110/22 with new rules for the Digital Microcredit Simplification Program for Entrepreneurs, known as Digital SIM. The MP also changes the dates of payment of social security contributions, such as the Severance Indemnity Fund (FGTS).
SIM Digital is a credit offer program for individual entrepreneurs. The provisional measure amends the rules of a previous MP with the aim of providing “greater legal certainty” and correcting possible material errors in the previous text, “in order that the scope intended by the Digital SIM and other procedures is achieved clearly and efficient”.
Among the changes is that the commercial portfolios of credit operations contracted through financial institutions participating in SIM Digital will be able to have guarantee instruments maintained by guarantee funds for microfinance operations. The rules for the use of guarantees will follow the provisions of the fund’s regulations.
The MP also defines that the shareholder, or its public agents, will not be liable for any obligation or possible damage to the guarantee fund, except for the shareholder, for the payment of the shares that it subscribes.
FGTS
Regarding the FGTS, the MP brings new dates for the payment of labor charges, especially for the domestic employer. According to the text, the collection of labor charges for which the domestic employer is responsible for his employee must take place by the 20th of each month. Only the salary must be paid by the 7th of each month.
“The production of effects of the new dates for the collection of labor charges by the domestic employer will only take effect when the date of commencement of collection through the provision of digital services for the generation of the respective guides”, informed the General Secretariat of the Presidency of the Republic. .
