House Committee approves PEC that grants amnesty to parties that fail to comply with quota

The special commission of the Chamber of Deputies that analyzes the application of resources in female candidates approved this Tuesday (22), by 19 votes to 2, the report by deputy Margarete Coelho (PP-PI). The collegiate analyzes the Proposed Amendment to the Constitution (PEC) 18/21, already approved by the Federal Senate.

In her report, Margarete Coelho maintained the punishments for parties that did not respect the minimum of 30% of women candidates in the elections prior to the PEC. If approved, the amnesty provided must be valid only for the non-application of resources. In the parliamentarian’s assessment, the parties’ action in the 2020 elections was hampered by the restrictions of the covid-19 pandemic.

“Someone who is in favor of amnesty is not speaking here. I am recognizing a period of exception, a period in which political parties were unable to apply certain legal or constitutional percentages as a result of the pandemic”, clarified the rapporteur.

The deputy withdrew from the proposal the permission for parties to accumulate resources destined for female candidacies, making the expense at a more convenient time. In the rapporteur’s assessment, the measure would be a setback.

The text establishes that no sanctions will be applied to parties, including the return of values, fines or suspension of the Party Fund, which did not meet the minimum quota of resources or who did not allocate the minimum values ​​of sex and race in past elections.

Procedure

Margarete Coelho chose to make only wording amendments to the text, so that it does not have to return to the Senate, where it could be amended. Originally, the PEC provided for an amnesty for parties that had not met the minimum gender quota or had not allocated the corresponding amounts to these candidacies in the last elections.

This Wednesday (23), deputies will vote on highlights presented by PSOL and Novo. The parties are against amnesty. If approved, the matter will go to the plenary of the Chamber and will need the vote of at least 308 deputies, in two rounds. If not modified, the text goes on for promulgation.

Supreme

In 2018, the Federal Supreme Court (STF) decided that the distribution of resources from the party fund intended for the financing of electoral campaigns aimed at women candidacies must be made in the exact proportion of candidacies of both sexes, respecting the minimum level of 30% of female candidates.

The obligation to use 5% of the party fund to promote women’s political participation is already provided for in the Political Parties Law. The PEC includes both rules in the Federal Constitution.
