The Attorney General of the Republic, Paulo Gonet, sent a recommendation to the other branches of the Public Ministry so that the payment of retroactive payments respects the constitutional salary ceiling of R$ 46,300.
Penduricalhos are benefits, which, added to the salary, exceed the constitutional ceiling.
The information is in a statement sent this Monday (2) by the National Council of the Public Ministry (CNMP), a body chaired by Gonet, to Minister Gilmar Mendes, of the Federal Supreme Court (STF)
Last Friday (27), Mendes reaffirmed his decision that prohibited the payment of handouts to members of the Public Ministry and the Courts of Justice and vetoed the carrying out of financial reprogramming to speed up retroactive transfers.
Furthermore, the minister also ordered the CNMP to provide clarifications on compliance with the decision.
In the clarifications, the council’s internal affairs department informed that the recommendation is that extra payments not be made.
“The recommendation establishes that the sum of retroactive payments cannot exceed the monthly limit of R$46,366.19, and payments must be interrupted after the 45-day period set out in ADI No. 6,606/MG, with the anticipation of funds scheduled for subsequent months being prohibited, as well as the carrying out of any financial reprogramming aimed at concentrating, accelerating or expanding disbursements,” stated the council.
Last week, the The Supreme Court postponed until March 25th the definitive vote on the decisions of Gilmar Mendes and Flávio Dino that suspended the payment of penduricalhos in the Three Powers.
